answer text <p>No action to refuse leave on the grounds of a questionable certificate was taken against anybody without first giving them the opportunity to re-sit their test with another provider or attend an interview with a Home Office official.</p><p>Whilst ETS notified the Home Office of 22,694 questionable UK test certificates, the actual number where it was relevant to require a fresh test and an interview with a Home Office official was much smaller. The exact information requested is not held centrally, and could only be provided at disproportionate cost.</p> more like this

answer text <p>We are continuing to review the position for those who remain in the UK who have live litigation. As a result of the Immigration Act 2014 there is now only a right of appeal where claims raising asylum, humanitarian protection or human rights claims are refused.</p><p>Similar provisions are set out in the Immigration (European Economic Area) Regulations 2016<em>. </em>Some of those refused as a result of an allegation of ETS fraud have made a Human Rights claim and will have an in country right of appeal if refused (unless the claim is clearly unfounded).</p><p> </p> more like this

answer text <p>As previously set out to the Home Affairs Select Committee (HASC), where ETS analysis found no direct evidence of cheating but they could not be confident in the test result because of the large number of confirmed invalid results at the same test centre, a test result would be deemed “questionable”.</p><p>Nobody with a questionable test certificate should have action taken against them on this basis without first being given the chance to re-sit a test and attend an interview.</p> more like this

For those with an invalid certificate, the Court have consistently found that our standard evidence is sufficient to satisfy the presumption of fraud.</p> more like this

answer text <p>Further to PQ 140550, a number of steps were taken to ensure that the ETS process for declaring test results invalid was suitably robust. This included commissioning an independent expert report from a leading Professor of Forensic Speech Science which concluded that the number of false matches would be very small, and that the system used were more likely to produce false negatives than false positives.</p><p>Where a result was marked as questionable, nobody was refused immigration leave on that basis without first being given the opportunity to re-sit a test with another provider or attend an interview.</p> more like this
