In the case of retained law relating to habitats, this information completed the quality assurance process only after Cabinet Office’s deadline for publication, so was not able to be included in the initial data. answer text <p> </p><p>The Court of Justice of the European Union ruled, on 18 October 2012, that by failing to ensure appropriate collection and associated treatment of urban waste water at London and Whitburn, the United Kingdom had failed to fulfil its obligations under the Urban Waste Water Treatment Directive (Case C-301/10). The Department is currently in discussion with the European Commission on how to give effect to the Court’s judgment. Since May 2010, no other infraction cases in respect of matters for which my Department is responsible have resulted in adverse judgements against the UK by the European Court.</p><p> </p> more like this

answer text <p>An EU regulation is adopted by a legislative procedure, i.e. by the ordinary legislative procedure or by a special legislative procedure, (see Article 289(3) of the Treaty on the Functioning of the European Union (TFEU)). The legal effect of an EU regulation is that it is directly applicable in the national law of all the Member States and it is binding in its entirety, (see Article 288 TFEU). The Government does not centrally hold information on each EU regulation issued since 1976. answer text <p>The European Commission has committed itself to withdraw, modify or repeal legislative proposals through a number of processes. In the 2015 Commission Work Programme, there were 80 proposed withdrawals. Of these, 73 have now been delivered. The remaining seven have been modified by the Commission, or were proposals where the Council and the European Parliament had not been able to come to an agreement, but have since made progress. A list can be found in the Official Journal of the European Union [http://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=OJ:C:2015:080:FULL&amp;from=EN]. In the 2016 Commission Work Programme, the Commission is working on the withdrawal or modification of a further 20 proposals. The Commission has also reduced the number of new initiatives proposed in its annual work programmes by over 80 per cent compared to 2014.</p><p>Under the UK’s new settlement with the EU, the European Commission has agreed for the first time to set specific targets to reduce the overall burden on business in key sectors. The Commission has also committed to ‘establish a mechanism to review the body of existing EU legislation for its compliance with the principle of subsidiarity and proportionality’; in setting priorities for this review, the Commission will be duty-bound to consult the Council and national parliaments. REUL not in scope of the sunset will be assimilated into the domestic statute book, by the removal of the special EU law features previously attached to it.</p><p>The dashboard presents an authoritative, not comprehensive, catalogue of REUL. Therefore, there may be some legislation that is covered by clause 1 of the Bill that is not yet captured in the dashboard. The Government will continue to identify additional REUL and update the dashboard on a quarterly basis to reflect this.</p> more like this

answer text <p>The Retained EU Law (REUL) Dashboard, published in June 2022, lists the 2,417 pieces of REUL identified at that point in time. This Dashboard will be updated on a quarterly basis as REUL is repealed and replaced, or more REUL is identified.</p><p> </p><p>The Department for Business, Energy and Industrial Strategy has worked closely with The National Archives on the underlying dataset. As part of this, the Department has asked The National Archives to search their archive for REUL that is no longer associated with an existing ministerial department. The aim of this work is to ensure that all REUL has been identified and the results will be added to the REUL dashboard.</p> more like this
