This includes payments from the following Trusts/Funds: Macfarlane, Eileen Trust and Skipton Fund.</p><p> </p><p>Any capital resource which derives from a payment from these Trusts/Funds, such as interest, is also disregarded indefinitely.</p><p> </p><p>Money which derives from the Trusts/Funds which is transferred to a partner is disregarded indefinitely in any benefit claim made by the couple. It is also disregarded indefinitely in any claim made by the partner after the sufferer’s death providing that the couple were not estranged or divorced at the time of the death. This emphasised the need for any new policy framework to have a focus on better regulation, supporting the single market and economic growth as well as sharing good practice between member states and supporting SMEs on risk management.</p><p> </p><p>The government was therefore pleased to see the commitment to simplify EU health and safety at work legislation in the new EU Strategic Framework, and is continuing to engage with the Commission to help realise this aim. 	answer	answer is ministerial correction date of answer 21/10/2014 answer text <p /> <p>Responsibility for recovery of Housing Benefit overpayments lies with the Local Authority who paid the Housing Benefit and now seek to recover it. They will make the decision firstly on whether it is an overpayment and secondly whether it is recoverable and from whom it is recoverable.</p><p> </p><p>The legislation provides for instances of recovery of housing benefit overpayments direct from the landlord where it has been paid to the landlord as long as the overpayment is recoverable and the Local Authority has decided to recover it.</p><p> </p><p>However, if the overpayment arose as a result of a misrepresentation or a failure to disclose a material fact by the tenant, or an appointee, then it can only be recovered from the person who misrepresented or failed to disclose i.e. the tenant or the appointee.
