star this property answer text <p>In order to access Driver and Vehicle Licensing Agency data, parking operators must belong to one of two trade bodies, the British Parking Association (BPA) or the International Parking Community (IPC). Both the BPA and the IPC cap the maximum penalty a private parking operator can apply at £100, with a mandatory 40 per cent reduction if payment is received within two weeks of a Parking Charge Notice being issued.</p><p>The Government supports Sir Greg Knights’ Parking (Code of Practice) Bill, which seeks to create a single code of practice for the parking industry. Should the Bill pass, there will be an opportunity to consider obligations on private parking operators, including the maximum level of penalty they can charge.</p> more like this

star this property answer text <p>The Protection of Freedoms Act 2012 grants keeper liability for vehicles, allowing landowners and parking operators to pursue the registered keeper of a vehicle for breaches of contract related to parking. Private parking companies must be a member of a trade association if they wish to access DVLA data in order to issue parking charges to vehicle owners. The two parking trade associations, the British Parking Association (BPA) and the International Parking Community (IPC), have their own codes of practice and appeal procedures to which they expect their members to adhere. If a private parking company does not follow these codes responsibly, they risk being banned from accessing DVLA data and will be unable to issue parking charges.</p> more like this

star this property answer text <p>The Great British Coast has enormous potential and this Government is determined to see it thrive all year round. We are committed to supporting coastal communities to unlock barriers to their development and growth, and to strengthen their appeal as places to live, work and visit.</p><p>Parking is the responsibility of local authorities and it is for them to determine what is appropriate in their own area. Central government has no remit to intervene in local authorities’ day to day affairs. The Government recognises that councils should be treating motorists fairly and promoting their town centres through their parking plans.</p><p>In line with the Local Authority Transparency Code, local authorities should each year publish their costs and profits relating to their parking management, allowing the public to hold certain overzealous councils to account.</p> more like this

star this property answer text <p>My department is leading on the implementation of the Parking (Code of Practice) Act 2019, which includes creation of an independent Code of Practice for private parking companies to improve standards.</p><p>MHCLG is developing the Code of Practice through the British Standards Institution (BSI) in close consultation with key stakeholders, including landowners, consumer organisations, and the private parking industry, who are advising on its impact. star this property answer text <p>In its response to the parking Code Enforcement Framework consultation in March 2021, the Government announced its intention to implement a series of fairer parking measures which will benefit motorists. These include the creation of a single independent appeals service for motorists to turn to if they receive a private parking charge and an Appeals Charter which will protect motorists from charges that are unfair or issued in error.</p><p>On 26 May, the Government announced that it will conduct a further technical consultation on its proposed changes to parking charges, seeking views from motorists, parking operators and landowners on the level of private parking charges, including the Appeals Charter. This will help deliver a fair, proportionate and consistent system across the country. Further details of the consultation, including delivery timescales for the single appeals service, will be announced shortly.</p> more like this

star this property answer text <p>The Government promotes a system of self-regulation by the private parking industry. Private parking companies must be a member of a trade association if they wish to access the Driver and Vehicle Licensing Agency (DVLA) data and then issue parking charges to the owner of a vehicle. The two parking trade associations, the British Parking Association (BPA) and the International Parking Community (IPC), have their own codes of practice and appeal procedures to which they expect their members to adhere.</p><p>Sir Greg Knight has introduced a Private Members’ Bill that seeks to create an independent code of practice for private parking companies. In line with the Manifesto, the Government fully supports Sir Greg’s Bill and seeks to get the fairest deal for motorists whilst helping to tackle rogue private parking companies. Should the Bill progress, there will be an opportunity to consider the obligations on private parking companies. The Bill is due for second reading on 2 February 2018. The consultation closed on 27 August and the department is finalising its analysis of the responses. star this property answer text <p>Section 7 of the Parking (Code of Practice) Act 2019 gives the Secretary of State the power to appoint a single appeals service to handle appeals against private parking charges. However, as a parking charge is an invoice for an alleged breach of the terms and conditions that applied at that particular time, the Act does not provide the power to cancel parking charges retrospectively. <br> <br> Additionally, the appeals window for many historic charges would have closed by the time the new appeals system is operating, which would risk court action for motorists with longer standing appeals. <br> <br> My Department is undertaking work to better understand the requirements of the new appeals service, and as part of that will consider how best to transition from the current appeals services, including ensuring that cases still being handled under the current services are treated fairly and in line with the new Code and its enforcement mechanisms.</p> more like this

star this property answer text <p>The 10-minute grace period at the end of paid for or free parking became mandatory for all Civil Enforcement Authorities in England on 6 April 2015. The grace period only applies at the end of permitted paid-for or free parking at local authority owned or operated car parks. It does not apply at the start of a period of parking, nor in circumstances where the driver was not permitted to park (i.e. outside the hours of permitted operation of on-street parking). There are no plans to mandate councils to give 10 minutes of free parking when parking begins. <br> <br> Statutory guidance makes clear that if an on-street parking meter or pay-and-display machine is out of order (and parking has not been suspended and clearly indicated as such to motorists), motorists should not be issued with a parking charge notice unless alternative means of payment were available to the driver and clearly indicated</p><p>Some private parking operators currently offer 10-minute grace periods. However, the new Private Parking Code of Practice my department is currently reviewing will make it a requirement across the country to provide a fixed consideration period of at least 5 minutes to ensure that motorists have an opportunity to familiarise themselves with the parking terms and conditions and give a minimum 10-minute grace period after their tickets expire.</p>

star this property answer text <p>The Secretary of State recently wrote to all local authorities in England setting out his expectations that parking services for which councils are responsible for remain accessible. For example, it would not seem appropriate for parking on a high street to be solely available for those who have access to a mobile phone. Nor would it appear sensible for local authorities to phase out paper-based parking options such as 'scratch cards' if the only available replacement is an entirely digital option.</p><p>All local authorities have statutory duties to ensure that they do not discriminate in their decision making against older people or those with vulnerabilities. Cash remains legal tender and it will continue to be used by people who favour its accessibility and ease. Local authorities should ensure that there are alternative provisions for parking payments available so that no part of society is digitally excluded.</p><p>A copy of the letter is available on gov.uk</p><p>Questions about medical appointments should be directed to the Department of Health and Social Care. star this property answer text <p>The figures published by the RAC Foundation are based on data returns published by my Department. Council returns’ suggest that profit (“net income”) on parking services was £635 million in 2013-14. Penalty charge income from on-street parking was £343 million. The RAC Foundation observe that some councils’ operational costs have fallen due to greater efficiencies, overall gross income has increased; as a result, net profit has risen. Legislation and guidance is clear that on-street parking should not be used as a source of general revenue.</p><p> </p><p> </p><p> </p><p>Unreasonable parking charges and fines push up hard-working people's cost of living. If parking is too expensive or difficult, shoppers will simply drive to out of town supermarkets or just shop online, undermining the vitality of town centres and leading to ‘ghost town’ high streets. This Government has rejected the last Administration’s policy of encouraging higher parking charges and aggressive parking enforcement, and is standing up for hard-working people and local shops.</p><p> </p><p> </p><p> </p><p>We are introducing a series of reforms, including:</p><p> </p><p> </p><p> </p><p>· Stopping the abuse or misuse of on-street parking CCTV;</p><p> </p><p>· Reforming operational parking guidance so it is less heavy handed with motorists, prevents over-aggressive action by bailiffs, positively supports local shops and clearly reinforces the prohibition against parking being used to generate profit;</p><p> </p><p>· Introducing mandatory 10 minute “grace periods” at the end of on-street paid and free parking, and looking to extend this to off-street municipal parking;</p><p> </p><p>· Implementing a new right to allow local residents and local firms to demand a review of parking in their area, including charges and the use of yellow lines;</p><p> </p><p>· Proposing a widening of the powers of parking adjudicators, and updating guidance so the public know when they can be awarded costs at tribunals;</p><p> </p><p>· Trialling a 25% discount for drivers at appeal stage, reversing the current disincentive for drivers with a legitimate case to appeal; and</p><p> </p><p>· Changing guidance so drivers parking at an out-of-order meter are not fined if there are no alternative ways to pay.</p><p> </p><p> </p><p> </p><p>We have also recently updated the local government Transparency Code to increase information about local parking charges and the number of parking spaces, which we expect councils now to implement as required by the statutory code.</p><p> </p><p> </p><p> </p><p>The measures on curtailing parking CCTV are contained within the Deregulation Bill, and I hope that noble peers will be supporting our measures at Report Stage in light of the figures in the RAC Foundation report.</p><p> </p>

Local authorities are responsible for setting local parking charges taking account of local circumstances.</p><p>We want local authorities to adopt policies that support local town centres, and have recently consulted on &quot;Strengthening Local Government Transparency&quot;. The consultation included a proposal to increase the amount of information local authorities would need to publish on parking thereby helping local communities to better understand what revenues were being raised from parking.</p><p>The intention of this proposed change would be to encourage a better local dialogue between communities and the local authorities that represent them about what appropriate parking charge levels should be.</p><p>We are currently analysing responses to the consultation and will publish our response in due course.</p> more like this

This Government is taking steps to tackle rogue and unfair practices by private parking operators. We have put in place a range of measures to reform the behaviour of private parking companies, including the banning of wheel clamping and towing.</p><p>The discussion paper entitled ‘Parking reform: tackling unfair practices’, sought thoughts and comments on the private parking sector. star this property answer text <p>We have already taken steps to tackle rogue and unfair practices by private parking operators, including the banning of wheel clamping and towing.</p><p>Private parking companies receive DVLA data on the condition that it will only be used to help follow up alleged parking contraventions. It cannot be further processed for any other purpose. The audit by the Information Commissioner’s Office in March 2016, judged the DVLA’s procedures to offer high assurance that processes to mitigate the risks of non-compliance with the Data Protection Act are in place.</p><p> </p> more like this
