star this property answer text <p>Ministry of Justice (MOJ) does not routinely hold data on barristers’ specialisms. However as part of the Criminal Legal Aid Review, MOJ worked with the Bar Council and other stakeholders to combine key datasets which were summarised in a published <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/960290/data-compendium.pdf" target="_blank">Data compendium</a>. This shows that the number of barristers in England and Wales who reported themselves as specialising in crime, and who carried out some publicly-funded criminal work, was 2,780 in 2018-19 and 2,690 in 2019-20 (<a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/960291/data-compendium-tables.ods" target="_blank">Table 5.3</a>). Comparable data is not available prior to 2018-19.</p><p><a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/960291/data-compendium-tables.ods" target="_blank">Table 5.13</a> shows that, in 2019-20, 87% of this group were junior barristers and 13% were QCs.</p>

The current site in Blackpool has been prepared to receive staff transferring from Liverpool and Cheadle Hulme with the first staff transferring from 5 June over a three-month period.</p> more like this

star this property answer text <p>The Ministry of Justice only collects information on how many defendants are prosecuted and convicted for each offence in any given year. Currently, information is not collated on whether a prosecution or conviction relied on the law of joint enterprise. Such information may be held on court records but could only be obtained at disproportionate cost.</p><p> </p><p>The feasibility of collecting data on joint enterprise cases is being considered as part of the development of the Common Platform Programme. The Common Platform aims to provide a single case management system that will enable the sharing of evidence and case information across the Criminal Justice System.</p> more like this

star this property answer text <p>As part of the Rape Review action plan, the Law Commission is conducting an independent review of the law, guidance and practice relating to the trial process in prosecutions of sexual offences, including rape, with one aim being to better support understanding of consent and misconceptions about sexual harm. As part of this project, the Law Commission will also consider how law and guidance can counter jurors’ misconceptions about sexual harm (“rape myths”) in relation to the credibility, behaviour and experience of complainants and defendants.</p><p>We await the results of the Law Commission’s review, and will carefully consider how the findings can contribute towards this government’s ambition to improve the treatment of victims, boost successful rape prosecutions, whilst also ensuring that defendants receive a fair trial.</p><p>In the meantime, to help address the attitudes and behaviours that can underpin these violent crimes, this Spring the government launched ‘Enough’: a new nationwide communications campaign which aims to challenge perpetrators and the harmful attitudes that exist within wider society, educate young people about healthy relationships and ensure victims can access support.</p>

star this property answer text <p>No assessment of the effect of the Equal Treatment Bench Book is made by the Ministry of Justice. To preserve the independence of the judiciary, the Lord Chief Justice (LCJ), the Senior President of the Tribunals, and the Chief Coroner have statutory responsibility for judicial training. These responsibilities are exercised through the Judicial College, which also produces the Equal Treatment Bench Book.</p><p> </p><p>Fair treatment is a fundamental principle embedded in the judicial oath and the Equal Treatment Bench Book is compiled by the judiciary to provide general guidelines for judicial office holders to apply as appropriate in any particular case. It is reviewed by a judicial editorial panel, with content from judicial experts and information from subject experts. The identities of the principal contributors appear in the Acknowledgments. The external documentary sources relied upon by the editors of the Bench Book are set out in full in the footnotes.</p> more like this

Engagement with stakeholders, including in the devolved administrations, is underway and roundtable events with religious, humanist and secularist groups are planned. In line with our manifesto commitment, we want to ensure there is a proper balance between the rights of individuals, our national security and effective government.</p> more like this
