answer text <p>Commercial leaseholders are protected if their landlord sells to a third party, as the new owner buys the land subject to the terms of any existing leases. This remains the case whether the original owner is a local authority or otherwise.</p><p>Local authorities may use ownership of commercial premises to generate a funding stream, and will consider whether continued ownership of assets provides value for money. These decisions are a matter for local authorities, provided they consider best value when making decisions on ownership or sale of assets.</p> more like this

answer text <p>The Government is committed to promoting fairness and transparency for leaseholders and freeholders in England, including the North East.</p><p>We want to make it easier for existing leaseholders to exercise their right to buy their freehold, or extend their lease, quickly, fairly and cheaply and for this right to be available as soon as possible. The Government is prioritising solutions for leaseholders of houses.</p><p>We are working with the Law Commission on introducing a cheaper and less complex statutory procedure for leaseholders to acquire a lease extension, or purchase the freehold, whilst ensuring that landlords obtain fair compensation.</p><p>The Law Commission has published its terms of reference at <a href="https://www.lawcom.gov.uk/project/leasehold-enfranchisement/" target="_blank">https://www.lawcom.gov.uk/project/leasehold-enfranchisement/</a></p><p>We will make further announcements in due course, and bring forward legislation at the earliest opportunity.</p><p> </p>

answer text <p>We are constantly working to ensure that protection for leaseholders is adequate. That is why on 21 December 2017, the Government set out a package of measures to tackle abuses and unfair practices in the leasehold market. This includes introducing legislation to prohibit the development of new build leasehold houses, other than in exceptional circumstances, restricting ground rents in newly established leases of houses and flats to a peppercorn (zero financial value) and working with the Law Commission to support existing leaseholders - including making buying a freehold or extending a lease easier, faster, fairer and cheaper. As part of the reform, we will consider extending the existing Right of First Refusal for flat lessees (Part 1 of the Landlord Act 1987) to house lessees. In general, the provision states that where a landlord is proposing to sell his interest in a building containing flats in relation to which the Right of First Refusal exists, they must, by law, first offer it to the tenants before offering it on the open market.</p>

answer text <p>The Government response to the consultation on ‘<em>Tackling unfair practices in the leasehold market</em>’ set out a range of measures to cut out unfair and abusive practices within the leasehold system. This included introducing legislation to prohibit the development of new build leasehold houses, other than in exceptional circumstances, and restricting ground rents in newly established leases of houses and flats to a peppercorn (zero financial value).</p><p>For existing leaseholders, the Government wants to see developer compensation schemes going further and faster, with support extended to all those with onerous ground rents, including second hand buyers and for customers to be proactively contacted. We will be keeping a close eye on progress and will consider measures that could be pursued to take action if necessary.</p><p>We want to make it easier for existing leaseholders to exercise their right to buy their freehold, or extend their lease, for this to be faster, fairer and cheaper, and to be available as soon as possible.</p>
