answer text <p>The terms on whether and how a deposit will be paid by the tenants of a commercial property and how this will be retained by the landlord should be included within the commercial lease agreement agreed by both parties. It may be useful to include in this a rent deposit deed setting out how the landlord will secure the deposit.</p><p>Under the tenancy deposit protection legislation introduced in the Housing Act 2004, all landlords letting on residential assured shorthold tenancies are required to protect their tenants' deposits in a government-approved scheme within 30 days of taking the deposit. We do not currently have any plans to require the use of a tenancy deposit scheme for commercial tenancies.</p><p>The letting agent or property manager should arbitrate any disputes between the landlord or tenant in the first instance. Since 1 October 2014, it has been a legal requirement for lettings agents and property managers in England to join one of two government-approved redress schemes (the Property Ombudsman or the Property Redress Scheme) and a complaint can be made to the relevant redress scheme should the letting agent or property manager be unable to arbitrate the dispute.</p>

answer text <p>Private Registered Providers of social housing, housing associations registered with the Social Housing Regulator, must comply with the Regulator's standards framework. The standard on allocations compels Private Registered Providers of social housing to allocate their properties in a fair, transparent and efficient way; taking into account the housing needs and aspirations of tenants and potential tenants. They must also demonstrate how their lettings make the best use of available housing, are compatible with the purpose of the housing, and contribute to local authorities’ strategic housing function and sustainable communities. As private bodies, it is for Private Registered Providers of social housing to create and implement an allocations strategy for their properties that enables them to meet the requirements of this standard.</p><p>The Regulator’s standards framework also requires that Private Registered Providers of social housing work in partnership with other public agencies to prevent and tackle anti-social behaviour in the neighbourhoods where they own homes and demonstrate that prompt, appropriate and decisive action is taken to deal with anti-social behaviour before it escalates.</p><p>The Regulator's standards are published at:<br><a href="https://www.gov.uk/guidance/regulatory-standards" target="_blank">https://www.gov.uk/guidance/regulatory-standards</a>.</p><p> </p>

answer text <p>There are no plans to make the Association of Residential Managing Agents (ARMA) a member of the Regulation of Property Agents Working Group. The composition of the working group's membership needs to reflect a balance of interests between property agents and housing consumers.</p><p>Already included within the working group are two professional bodies with knowledge and experience of property management: the Royal Institute of Chartered Surveyors and the Institute of Residential Property Management. Both these organisations have members who are also members of ARMA, or work on behalf of them. The working group will wish to invite others to personally provide evidence and give their views. When the working group discusses managing agents, ARMA will be at the forefront of the list of organisations for this purpose.</p> more like this

answer text <p>We recognise the importance of providing personalised support and its role in helping people who are rough sleeping or have a history of doing so.</p><p>As this is a devolved issue, MHCLG does not cover homelessness and housing policy in Wales and therefore, the following information relates only to England.</p><p>In August, we announced funding for ‘navigators’ who will support individuals from their first contact with services through to settled accommodation and will be able to make use of personalised budgets where appropriate. We recently launched a prospectus for our Rapid Rehousing Pathway, which will include navigators and we expect early adopters to start delivering in early 2019.</p><p>We are also funding seven Social Impact Bonds (SIBs) to work with long-term rough sleepers who have multiple complex needs towards positive accommodation, employment and health outcomes. The SIB model includes a personalised budget that can be flexibly used to best support individuals to maintain their accommodation and improve their wellbeing.</p>

answer text <p>Under the Housing Act 2004, all deposits taken with assured shorthold tenancies since 6 April 2007 must be protected in a Government-approved tenancy deposit scheme within 30 days. In the vast majority of cases the deposit can be returned promptly as the landlord and tenant are able to agree deductions from the deposit. Deposits should be returned within 10 days of the tenant requesting it if held in the insured scheme, and within 10 days of the landlord and tenant agreeing deductions in the custodial scheme. It can take longer if they cannot agree and need to use the free dispute resolutions services provided by the deposit schemes. Only 1.5 per cent of cases go to formal dispute. The YouGov survey referenced in the news release asked about the worst experience tenants had ever had and so is not representative of the normal experience for tenants.</p><p>The current system works well but we are reviewing whether improvements can be made to the deposit protection model through the Tenancy Deposit Protection Working Group. Nationwide is a member of the Working Group which will look at the process at the end of tenancy and dispute resolution, as well as exploring whether deposit passporting can improve affordability by helping tenants who have to pay a deposit to their new landlord before they receive their current deposit back.</p>

answer text <p>The Social Housing Green Paper recognises many landlords play a role that goes beyond their key responsibilities, which includes providing guidance to vital services such as mental health services. Through the Green Paper, we are seeking to gather evidence on the impact of the important role that many social landlords are playing.</p><p>Social housing and more widely, supported housing, provides a vital service for vulnerable people, including people with mental health issues. Safeguarding provision and supply of appropriate supported accommodation is a priority for my department and we will continue to provide capital grant funding to promote new supply of supported housing.</p><p>Our recent announcement confirming funding for all supported housing will stay in Housing Benefit, will also give confidence to the sector to continue to invest in new supply. We are also reviewing oversight arrangements for all supported housing. As a Government, we are investing record levels in mental health, spending £11.98 billion in 2017/18.</p>

answer text <p>The Secretary of State has regular discussions with the Secretary of State for Health and Social Care on matters of mutual departmental interest, including through the Rough Sleeping and Homelessness Reduction Taskforce.</p><p>We recognise that poor mental health can both contribute to, and be exacerbated by, homelessness and rough sleeping. Having stable and appropriate housing is invaluable for people living with a long-term mental health problem. We also know that rough sleeping can exacerbate existing, underlying mental health conditions and can result in a mental health crisis.</p><p>In 2018/19 the Department for Health and Social Care will provide up to £2 million in health funding to test models of community-based provision designed to enable access to health and support services for people who are sleeping rough. This will include services to support people with both mental ill health and substance misuse issues. We are undertaking a rapid audit of provision targeted at people who sleep rough that can be used to inform future commissioning decisions. The Department for Health and Social Care has asked NHS England to spend up to £30 million on health services for people who sleep rough, over the next five years.</p>
