answer text <p>The Government is committed to promoting fairness and transparency for homeowners and ensuring that consumers are protected from abuse and poor service. We are taking forward a comprehensive programme of reform to end unfair practices in the leasehold market.</p><p>The Government asked the Competition and Markets Authority (CMA) to investigate potential mis-selling of homes and unfair terms in the leasehold sector. On 19 March 2021, the CMA announced that it is requiring the removal of ground rent terms which it thinks are unfair from all existing Countryside and Taylor Wimpey contracts to make sure they are no longer in breach of the law. The companies must also agree not to use the terms again in any future leasehold contracts. On 23 June the CMA announced commitments secured from Aviva and Persimmon to amend their practices regarding doubling ground rents and houses sold as leasehold. This is a hugely important step and demonstrates our determination to support affected leaseholders.</p><p>In January we announced we will abolish marriage value, cap the treatment of ground rents at 0.1% of the freehold value, and prescribe rates for the calculations at market value. We will also introduce an online calculator, further simplifying the process for leaseholders and ensuring standardisation and fairness for all those looking to enfranchise. Through our reforms, the length of a statutory lease extension will increase to 990 years, from 90 years (for flats) and 50 years (for houses). Leaseholders will be able to extend their lease with zero ground rent on payment of a premium. Leaseholders will also be able to voluntarily agree to a restriction on future development of their property to avoid paying ‘development value’.</p><p>Having closely reviewed the Law Commission’s report on Commonhold we have established a new Commonhold Council as a partnership of industry, leaseholders and Government that will prepare homeowners and the market for the widespread take-up of commonhold. This will take time and close working with consumers and industry, and the Commonhold Council will be the critical first step of this.</p><p>The Government will respond to the Law Commission’s remaining recommendations on enfranchisement, commonhold and right to manage in due course.</p><p>We have brought forward legislation in the Leasehold Reform (Ground Rent) Bill to set ground rents on newly created leases to a genuine ‘peppercorn’ rate of only one peppercorn per year or effectively zero financial value. This will be the first part of seminal two-part legislation to implement reforms in this Parliament.</p>

answer text <p>This Government is committed to tackling unfair practices in the leasehold market. We have committed to banning new leasehold houses and restricting ground rents to a peppercorn and launched a technical consultation on the details of these proposals which closed on 26 November. We will publish the Government response in due course and bring forward primary legislation as soon as Parliamentary time allows.</p><p>We are also working with the Law Commission to make it faster, fairer and cheaper for existing leaseholders to extend their lease or buy the freehold. The Law Commission have also consulted on making Right to Manage legislation so that leaseholders can more easily take control of running their buildings. The Government will consider next steps when the Law Commission reports later this year</p><p>In addition, we have also set up a Working Group, chaired by Lord Best, to look at how property agents can be improved, including a single, mandatory Code of Practice for managing agents and whether any fees should be capped or banned. We expect to receive the Working Group's recommendations this summer and we will respond with our plans later this year.</p><p>We recently announced a new government-backed industry pledge to make sure that leaseholders whose leases contain onerous terms such as doubling ground rents within 20 years, get the support they need. The new pledge announced on 28 March has been signed by more than forty leading property developers and freeholders.</p><p> </p><p> </p><p> </p><p> </p>

answer text <p>The Government's consultation 'Tackling unfair practices in the leasehold market' ran for eight weeks from 25 July to 19 September 2017. The consultation received 6,075 responses; 5,701 via an online survey and 374 via email and post. Of those responding to the online survey providing background information, 5,336 respondents said they were private individuals, of which 2,790 answered a follow up question confirming they were a leaseholder living in a house, with 1,699 confirming they were a leaseholder living in a flat and 431 identifying themselves as a freeholder. 332 respondents identified themselves as replying to the consultation on behalf of an organisation.</p><p>A full breakdown of responses by type and question can be found at Annex A of the Government response, published on 21 December 2017 available at <a href="https://www.gov.uk/government/consultations/tackling-unfair-practices-in-the-leasehold-market" target="_blank">https://www.gov.uk/government/consultations/tackling-unfair-practices-in-the-leasehold-market</a>.</p><p>The Government also ran a separate technical consultation, ‘Implementing reforms to the leasehold system’ during 15 October 2018 to 26 November 2018, and is still analysing the responses. As part of our consultation questions we did not ask the respondent to identify whether they were a leaseholder. However, we received 1030 responses which were completed as personal views.</p>
