answer text <p>The Data Protection Bill was introduced on 13 September. The Bill is intended to create a new data protection framework fit for the digital age, which incorporates the provisions of the EU’s GDPR into domestic law. It builds on existing standards for protecting personal data, in accordance with the GDPR, giving people more control over use of their data, and providing new rights to move or delete personal data.</p><p> </p><p>The EU (Withdrawal) Bill will ensure that the remainder of the GDPR is incorporated into domestic law.</p><p> </p><p>In leaving the European Union, we will bring about an end to the direct jurisdiction of the CJEU in the UK.</p> more like this

answer text <p>Clause 6 of the EU (Withdrawal) Bill provides that UK courts must continue to interpret unmodified retained EU law in accordance with retained EU case law and retained EU general principles, so far as they are relevant to that retained EU law. EU case law is retained to the extent it relates to anything falling within clauses 2-4 of the Bill, and is not excluded by clause 5 and Schedule 1.</p><p> </p><p>Clause 6 also provides that the UK Supreme Court and High Court of Justiciary will be able to depart from pre-exit CJEU case law, using the the same tests they do when departing from their own case law.</p><p> </p><p>This is without prejudice to the detail of the implementation period, which will be for negotiations.</p> more like this

answer text <p>The Government has been working with the hospitality sector across the country to understand the challenges and opportunities presented by the UK’s exit from the EU. At the recent Tourism Industry Council Professor Alan Manning, Chair of the Migration Advisory Committee, heard the sector’s views on the contribution of international employees and what the sector’s priorities are for the future immigration system. The sector has also agreed a proposal for a tourism sector deal which has a strong focus on developing domestic skills to meet employer demand and improving the attractiveness of the sector as a career path.</p><p> </p><p>The government wants businesses to benefit from the right skills, which is why we are working with employers to invest in training such as apprenticeships and high-quality technical education. answer text <p>The Privacy and Electronic Communications (EC Directive) Regulations 2003 (PECR) regulates the sending of electronic marketing messages (by phone, fax, email or text), as well as the provision of electronic communication services to the public. The Information Commissioner's Office independently regulate PECR and have been clear that organisations must not send marketing emails to individuals without explicit consent. Where these rules are not adhered to, the Commissioner is able to issue enforcement notices, as well as fines of up to £500,000. The Data Protection Bill currently going through the Houses of Parliament also includes tougher rules on consent and strengthens the rights of data subjects, giving them more control over their data.</p> more like this

answer text <p>The Government and the Information Commissioner recognise the challenges facing organisations across the UK in their preparations for the Data Protection Bill and the General Data Protection Regulation (GDPR). There are already resources on the Commissioner's website (ico.org.uk) to help organisations employing fewer than 250 people, including parish councils, prepare. The Commissioner has launched a dedicated helpline service for smaller organisations and has updated its 'SME toolkit' to reflect the requirements of the GDPR. The Commissioner will also be simplifying her &quot;12-step&quot; GDPR preparation guidance in response to feedback from small and micro-enterprises and will continue to develop further guidance on both the Bill and GDPR. Parish Councils, like other data controllers, are currently required to adhere to the Data Protection Act 1998. Although the General Data Protection Regulation (GDPR) does change the requirements on data controllers, the Government's view is that the step up to these new standards will not be a disproportionate burden. Officials have held discussions with the National Association of Local Councils.</p>
