      ], "answer" : {"_about" : "http://data.parliament.uk/resources/1364313/answer", "answerText" : {"_value" : "<p>Under the Transport Act (1985) all bus operators in England must give their respective local transport authority and Traffic Commissioner a combined 70 days\u2019 notice of their intention to permanently cancel any existing bus services.<\/p><p> <\/p><p>Where an existing operator intends to withdraw from the market, the local transport authority can use this time to broker discussions with remaining operators, to determine whether and to what extent they intend to operate any of those withdrawn services commercially. Moreover, the notice period described above can be reduced to help quickly register replacement services, helping to ensure continuity for passengers.<\/p><p> <\/p><p>The local authority also has powers under the 1985 Act to secure the provision of any services that will not be operated commercially, if it considers them to be socially necessary.<\/p><p> <\/p><p> <\/p>"}

      ], "answer" : {"_about" : "http://data.parliament.uk/resources/694241/answer", "answerText" : {"_value" : "<p>Public health is primarily a matter for local authorities, which includes preventative services around obesity and smoking cessation.<\/p><p> <\/p><p>Clinical commissioning groups (CCGs) are responsible for working with local authorities to understand and meet the needs of their local populations, and making decisions on how to best commission services which meet that population\u2019s health needs.<\/p><p> <\/p><p>NHS England does not have a formal process in place to ensure that CCGs provide obese patients and smokers with access to appropriate treatment before operations. However, CCGs are encouraged to obtain the advice of NHS England regional teams before putting forward proposals which would affect access to services.<\/p><p> <\/p><p>CCGs also have a legal duty to have due regard to National Institute for Health and Care Excellence guidelines.<\/p><p> <\/p><p>CCGs have a statutory duty to meet the reasonable health requirements of their local population. As part of their duty to seek continuous improvement in the quality of services they commission, CCGs must act with a view to securing continuous improvement in the outcomes of services. NHS England can exercise its formal powers of direction if it is satisfied that a CCG is failing or is at risk of failing to discharge this duty.<\/p>"}
