Universal Credit (UC) advances are available to claimants as a form of budgeting support, allowing them to better manage their finances. In most cases an advance would be repaid through a series of monthly deductions from their ongoing UC entitlement. The claimant is able to select the amount of time over which they repay their advance, currently up to a maximum of 12 months.<\/p>
<\/p>
If an advance is not recovered from the associated benefit claim because the claim ends or there was no entitlement to that benefit, the outstanding balance is treated as if it were an overpayment and referred to the Department\u2019s Debt Management team to arrange recovery.<\/p>
<\/p>
Where a debtor dies and leaves outstanding Social Security debt, the Department becomes a creditor of the estate and will then make a claim for these debts from the estate. Where it is established that there is no estate the outstanding balance is written off.<\/p>"}

The Help To Claim support is not a contract arrangement with Citizens Advice and Citizens Advice Scotland. They are funded by a grant agreement to deliver the Help To Claim service that runs alongside the national Jobcentre offer, and provides additional and alternative support for claimants who need help making their first claim. This personalised support helps to ensure that there is no need for a claimant to have their claim backdated to the point of contact. Instead, through either Citizens Advice or DWP, claimants are able to access immediate support to make their claim in a timely manner.<\/p>
<\/p>
There are some specific, designated circumstances in which the Department has the ability to backdate a claim, for example if someone is taken ill. However, there is not a legal basis whereby a third party, including Citizens Advice and Citizens Advice Scotland, can \u2018protect the date of claim\u2019 for Universal Credit claimants based on first contact. The Department recognises the importance of safeguarding the welfare of claimants who have incurred debt, and Universal Credit already has procedures and regulations in place to protect claimants from excessive deductions.<\/p>
A claimant\u2019s circumstances are always taken into account when applying debt repayment thresholds to avoid undue hardship. If a claimant is having difficulty repaying a benefit overpayment, they can request a reconsideration of the amount that is being taken. Any reduction will be based on the individual circumstances of the claimant rather than the amount of the overpayment, which helps to ensure that a sustainable repayment plan based on affordability is put in place.<\/p>
The maximum rate of deductions will not normally exceed an amount equal to 40 per cent of the Universal Credit standard allowance, and from October 2019 this maximum rate will be reduced to 30 per cent. However, where it is in the best interest of vulnerable claimants, to protect them from being made homeless or having their fuel disconnected, deductions in excess of the maximum rate may be applied. This is only for \u2018last resort\u2019 third party deductions for arrears of service charges, rent, gas and electricity. When we take deductions for gas and electricity arrears, we will also take them for the on-going monthly cost of these utilities.<\/p>
The Department has also implemented a range of measures to further support claimants such as providing a two-week \u2018transitional housing payment\u2019 for those who had been receiving Housing Benefit before transitioning onto Universal Credit, and interest free advances, worth up to 100 per cent of their indicative Universal Credit award which can be paid back over 12 months.<\/p>"}

No Universal Credit (UC) claimant has to wait five weeks for their first payment and there are many reasons why people use foodbanks.<\/p>
<\/p>
If required, advances of up to 100 per cent of their expected UC award are available to claimants from day one of their claim. Advances are paid back over a maximum of 12 months and in the Autumn Budget 2018, we announced that from October 2021, the payback period for these advances will be extended further, allowing claimants up to 16 months.<\/p>

This is just one of a number of measures the Department has put in place to support claimants such as paying those claimants moving from Housing Benefit onto UC a two week \u2018transitional housing payment\u2019.
