Clause 21 of the European Union (Withdrawal) Bill would allow the UK Government to meet fully the obligations set out in the Northern Ireland Protocol. The “Henry VIII” power in the clause could be used where necessary to amend primary legislation to ensure arrangements required in the Northern Ireland Protocol are operational and to implement the requirements set out in the Protocol.

In response to concerns raised by the Devolved Administrations, clause 18 of the Bill (Main power in connection with other separation issues) has been restricted so that powers under this clause cannot be used to amend the devolution acts, including the Government of Wales Act 2006.

The Government is working to establish whether restricting the powers in clause 21 in a similar way would mean the obligations in the Protocol could still be met. Subject to the outcome of this work, the Government would be open to imposing the restriction by amending the Bill during its passage.

Under the Enterprise Act 2002, Ministers have powers to intervene in mergers which raise public interest concerns in relation to national security, financial stability and media plurality. If the Government decides that there are grounds for intervention and that it should exercise its powers under the Enterprise Act in this case, it will make an announcement.

We issue a flexible 30-day visa to non-EEA nationals coming from overseas to stay in the UK for over six months to enable them to collect their biometric residence permits (BRP) shortly after they arrive in the UK.

When a family reunion application is made, individuals can specify the date they would like the 30-day visa to start to enable them to make any necessary travel arrangements, including obtaining exit visas. The start date of the visa can be deferred for up to three months from the date of application. If there is any delay expected in the processing time of the application, the individual will be contacted by UKVI and informed about the delay. Where someone is unable to make arrangements to travel to the UK within the 30 day period, they can apply for a replacement visa.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4210", "label" : {"_value" : "Biography information for Lord Ahmad of Wimbledon"} } , "answeringMemberPrinted" : {"_value" : "Lord Ahmad of Wimbledon"} , "dateOfAnswer" : {"_value" : "2016-06-16", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2016-06-16T14:56:52.313Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2016-06-07", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Worldpay"} , "houseId" : {"_value" : "2"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25277", "prefLabel" : {"_value" : "House of Lords"} } ], "questionText" : "To ask Her Majesty’s Government whether, in family reunion cases, they are considering providing entry visas valid for longer than 30 days, to enable visa holders to complete all the required exit procedures and necessary travel arrangements.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/2018", "label" : {"_value" : "Biography information for Lord Hylton"} } , "tablingMemberPrinted" : [{"_value" : "Lord Hylton"} ], "uin" : "HL522"} , {"_about" : "http://data.parliament.uk/resources/381606", "AnsweringBody" : [{"_value" : "Department for Education"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/381606/answer", "answerText" : {"_value" : "

Governing bodies are responsible for their school meals service including their packed lunch policies and whether to ban certain products to promote healthy eating. If schools wish to adopt such policies, we strongly recommend that they consult parents first and ensure that any adopted policy is clearly communicated to parents and pupils.

Schools have common law powers to search pupils, with their consent, for items. There is nothing to prevent schools from having a policy of inspecting lunch boxes for food items that are prohibited under their school food policies. A member of staff may confiscate, keep or destroy such items found as a result of the search if it is reasonable to do so in the circumstances. It would be good practice for the pupil to be present during an inspection and for a second member of staff to be present if any items are to be confiscated.

If authorities and schools are concerned about their legal position, they should seek their own legal advice.
