Section 54 of the Pensions Act 2008 prohibits employers from taking any action for the sole or main purpose of inducing a worker to leave a workplace pension scheme.<\/p>
The Government takes potential inducement by employers very seriously. The Pensions Regulator (TPR) is responsible for all matters relating to employers\u2019 compliance with their enrolment duties, including investigations into individual cases of potential inducement by employers.<\/p>
Through automatic enrolment we are delivering a fundamental shift in workplace pension saving that is changing the way that people are enabled to save for retirement. Already 100,668 employers have completed their declaration of compliance with the Regulator, resulting in more than 6 million eligible jobholders being automatically enrolled into a qualifying pension scheme.<\/p>
The law relating to inducements is an important safeguard for workers and the Regulator has statutory powers of investigation and enforcement it can use in appropriate circumstances. We are working with the Regulator to monitor the number and nature of possible inducement cases as the roll-out of automatic enrolment continues. That will enable us to judge whether the current legislation covering inducement, and the guidance and messaging provided by the Regulator, are operating effectively to protect employees, and whether change may be appropriate.<\/p>"}

Automatic enrolment has been a great success to date. Since the roll out of automatic enrolment, nearly 6 million people have been automatically enrolled into a workplace pension. Only 10% of individuals that have been automatically enrolled so far have chosen to opt out. This is one of the key indicators of the policy\u2019s success in increasing participation in pension saving.<\/p>
<\/p>
Individuals who have opted out of automatic enrolment and have subsequently changed their mind can discuss with their employer how to opt back in. Furthermore, employers are required by law to automatically re-enrol eligible workers every three years. This prompts individuals to periodically reconsider their saving arrangements. Employers also have duties to provide certain information to their workers within prescribed time limits.<\/p>
<\/p>
In addition, the national communications campaign, Don\u2019t Ignore the Workplace Pension,<\/em> raises awareness of pension saving among both employees and employers, and promotes the idea that saving in a workplace pension is normal. The campaign directs individuals to the campaign website, The Pension Regulator\u2019s website, and the relevant gov.uk website.<\/p>"}

We want to ensure that as many people as possible have the opportunity to save for retirement, and we have seen great success in this so far. However, we need to strike a balance between ensuring as many people as possible have access to saving, and administrative simplicity for employers.<\/p>
Workers earning more than £10,000 a year (£192 a week) and aged between 22 and state pension age must be automatically enrolled by their employer. Workers who do not qualify for automatic enrolment and who are aged between 16 and 75 years can choose to opt-in to a workplace pension scheme; and if the worker earns more than £5,824 a year (£112 a week) they will be entitled to a mandatory contribution from their employer.<\/p>

Between February and April 2015, the Government consulted on amending the Occupational Pension Schemes (Investment) Regulations in line with the Law Commission\u2019s recommendations. 47 responses were received, from a variety of organisations.
