The Government takes a considered and balanced approach to the recovery of benefit debt and HMRC has strong processes in place to support those that may be struggling to pay back tax credits overpayments with manageable recovery plans.<\/p>

<\/p>

HMRC calculates tax credit awards across the financial year to ensure customers receive regular and consistent financial support. Customers are required to tell us of any change in circumstances and when they do, awards are recalculated and balanced across the remainder of the period. Customers are made aware of any overpayment that is generated as a result and the process to challenge the overpayment if they do not agree it is correct.<\/p>

HMRC has a well-established approach to help tax credit customers who are having difficulty repaying a debt and require extra support, including offering its customers debt advice referral to the Money and Pensions Service Money Adviser Network for a free bespoke independent debt service.<\/p>

<\/p>

HMRC will work with customers and can agree a temporary reduction in the rate of repayment based on their financial circumstances. In some cases, recovery of the debt can be paused. During the same period, the Department wrote off £9.4 million Tax Credit debt for approximately 5,700 customers. The latest HMRC forecasts suggest that a further £2.4 billion is due to migrate to DWP Debt Management for future recovery. Therefore, based on the value of debt transferred to date and the forecast of further debt that will transfer, if all Tax Credits debt associated to UC claimants was written off it would cost in the region of £5.4 billion associated to approximately 4 million customers.<\/p>

The Department has a duty to protect public funds and an obligation to ensure that overpaid benefit payments are recovered in accordance with the appropriate social security legislation.<\/p>

<\/p>

The Department seeks to recover benefit overpayments as quickly as possible without creating any undue financial hardship to the claimant. The rate of deduction is determined by legislation and can only be calculated once other higher priority deductions have been taken into account. The maximum deduction that can be taken from someone\u2019s UC Standard Allowance was reduced to 25 per cent in April 2021.<\/p>

HMRC have built on existing measures to address the risk of tax credits claimants incurring overpayments. This activity incorporates improvements to education and guidance, including to identify and address error and fraud at an earlier stage.<\/p>

HMRC have delivered an ambitious training programme in 2019-20 to equip frontline staff with a wider range of tools and skills to help claimants maintain their correct entitlements. This includes continuing development of prompts to support conversations with claimants to keep their awards on the right footing.<\/p>

HMRC have extended the range of their education and reminder campaigns to promote the correct reporting of the various factors that affect a claimant\u2019s entitlement: for example, targeted letters to increase understanding of the criteria for single or joint claims or how to declare self-assessed income.<\/p>

HMRC have also put measures in place to respond to the impacts of COVID-19 on claimants\u2019 lives. In recognition that many claimants are not able to work their normal hours (including because they have been furloughed) the Government has legislated to suspend the eligibility criteria on \u201chours worked\u201d in Working Tax Credit for claimants temporarily affected by the pandemic. This eliminates a potential source of overpayments.<\/p>

For overpayments resulting from error and fraud, in five of the last six years for which results are available, HMRC have met the target set by ministers to restrict outturn levels to below five per cent of total expenditure. As part of our initial response to the Covid-19 pandemic we suspended recovery of all overpayment deductions as well as pausing notification of any new overpayments. The transfer of Tax Credit debts from HMRC to DWP was temporarily suspended as part of this approach.<\/p>

Recovery of existing Tax Credit overpayments from Universal Credit has now resumed, along with the transfer of new Tax Credit debt to DWP.<\/p>

There have been several discussions with HMRC, who own the Tax Credit Debt, to ensure that both the action of stopping tax credit collection and restarting has taken into account the customer perspective.<\/p>
