The management of the Wales & Borders franchise has been devolved to the Welsh Government (and its predecessor the Welsh Assembly Government) since April 2006. In 2018, those devolution arrangements were further strengthened in line with one of the recommendations of the Commission on Devolution in Wales (‘the Silk Commission’). In particular, the Welsh Government additionally took over responsibility for letting new Wales & Borders franchises from the Department for Transport.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/3996", "label" : {"_value" : "Biography information for Andrew Jones"} } , "answeringMemberConstituency" : {"_value" : "Harrogate and Knaresborough"} , "answeringMemberPrinted" : {"_value" : "Andrew Jones"} , "dateOfAnswer" : {"_value" : "2019-01-23", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-01-23T11:35:49.447Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "27"} , "answeringDeptShortName" : {"_value" : "Transport"} , "answeringDeptSortName" : {"_value" : "Transport"} , "date" : {"_value" : "2019-01-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Wales and Borders Rail Franchise"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Transport, for what reason it was decided to give responsibility for the Wales and Borders rail franchise to the Welsh Government.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/1566", "label" : {"_value" : "Biography information for Daniel Kawczynski"} } , "tablingMemberConstituency" : {"_value" : "Shrewsbury and Atcham"} , "tablingMemberPrinted" : [{"_value" : "Daniel Kawczynski"} ], "uin" : "209756"} , {"_about" : "http://data.parliament.uk/resources/1020136", "AnsweringBody" : [{"_value" : "Wales Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1020136/answer", "answerText" : {"_value" : "

It is the responsibility of the Welsh Government to procure the Wales and Borders rail franchise. However, should these circumstances arise, an extension of the existing Franchise Agreement could be called for seven railway periods (i.e. 28 weeks). There is also the potential to negotiate an extension of up to 65 railway periods with the existing franchisee, as well as the Department having the standard Railways Act Operator of Last Resort powers.

The Silk Commission report highlighted the need for co-operation on the future of the English parts of the Wales and Borders rail franchise. Agency Agreement No.2 (Schedule 1, paragraphs 6 to 8) between the Secretary of State and Welsh Ministers signed on 28th September 2017 makes clear that any such costs would usually be the responsibility of Welsh Ministers, and the exceptional circumstances when this would not be the case.
