The Crown Prosecution Service (CPS) maintains a Case Management System (CMS) which shows the number of defendants where a flag for rape has been added. This flag is applied at the onset of any case referred by the police to the CPS for a charge of rape and remains in place even if the charge is not proceeded with, is amended, or dropped. If a case is referred by the police for a charge other than rape, but subsequently a charge of rape is preferred, the flag is applied at that point.

The tables below show the number of completed prosecutions and convictions in cases where a flag for rape has been added, from 1 April 2006 to the end of September 2015 by quarter. The data provided in the table is in financial quarters.

The CPS’ CMS was introduced during 2004-2005. A national monitoring flag to manage cases where rape offences were referred or later charged was introduced from 1 April 2006. As with any new monitoring system, some variance is expected in the periods immediately following the introduction of a new flagging process.

‘Total completed prosecutions’ refer to the conclusion of a prosecution case against a defendant such as conviction after trial, guilty plea, acquittal, or the prosecution against the defendant being dropped. ‘Convictions’ refer to convictions after trial and guilty pleas.

Supporting victims of sexual violence and abuse is an absolute priority for this government.

We have taken a number of steps to support the mental health of victims while they wait for rape trials.

In December 2022, the Ministry of Justice launched the 24/7 Rape and Sexual Abuse Support Line to provide victims and survivors access to vital help and information whenever they need it.

In August 2023, we launched the recommissioned Rape and Sexual Abuse Support Fund, providing £26 million to over 60 specialist support services.

The Government is also quadrupling funding for victim and witness support services by 2024/25, up from £41 million in 2009/10. This includes additional ringfenced funding to increase the number of Independent Sexual Violence Advisors (ISVAs) and Independent Domestic Violence Advisors (IDVAs) to around 1,000 by 2024/25 - a significant increase on the number of ISVAs and IDVAs.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4004", "label" : {"_value" : "Biography information for Mike Freer"} } , "answeringMemberConstituency" : {"_value" : "Finchley and Golders Green"} , "answeringMemberPrinted" : {"_value" : "Mike Freer"} , "dateOfAnswer" : {"_value" : "2024-04-03", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2024-04-03T15:56:13.67Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2024-03-22", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Rape: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Justice, whether he is taking steps with Cabinet colleagues to help support the mental health of victims while they wait for rape trials.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4638", "label" : {"_value" : "Biography information for Mr Tanmanjeet Singh Dhesi"} } , "tablingMemberConstituency" : {"_value" : "Slough"} , "tablingMemberPrinted" : [{"_value" : "Mr Tanmanjeet Singh Dhesi"} ], "uin" : "20097"} , {"_about" : "http://data.parliament.uk/resources/1653398", "AnsweringBody" : [{"_value" : "Ministry of Justice"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1653398/answer", "answerText" : {"_value" : "

We recently published a process evaluation of the implementation of the pre-recorded cross-examination special measure (also known as section 28) for complainants of sexual and modern slavery offences on gov.uk. This was a qualitative evaluation which explored witness and practitioner views and experiences of section 28 to understand whether the provision was working as intended.

Ministry of Justice analysts are currently scoping an impact analysis of section 28 which will give us further qualitative data on if the measure influences the outcomes and delivery in these cases or impacts on the functioning of the courts overall.

The Ministry of Justice currently holds limited quantitative data on the use of special measures in rape cases, however we expect this to improve following the rollout of the Common Platform, a digital case management system which will be able to record special measure applications. As such we are currently unable to publish data on the number or proportion of rape cases that used special measures. However, on the criminal justice delivery dashboard we have published data which shows 433 witnesses in adult rape cases gave evidence using section 28 between January 2021 and December 2022.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4362", "label" : {"_value" : "Biography information for Edward Argar"} } , "answeringMemberConstituency" : {"_value" : "Charnwood"} , "answeringMemberPrinted" : {"_value" : "Edward Argar"} , "dateOfAnswer" : {"_value" : "2023-07-20", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-07-20T09:48:19.637Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2023-07-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Rape: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Justice, pursuant to Recommendation 6 of the Joint Inspectorate’s Phase Two report into the police and Crown Prosecution Service response to rape, published in February 2022, what steps he has taken to gather quantitative and qualitative data on the use of special measures in rape cases; and if he will publish data on the (a) number and (b) proportion of rape cases prosecuted in England and Wales where special measures have been used from 1 September 2022 to 30 June 2023.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/1536", "label" : {"_value" : "Biography information for Emily Thornberry"} } , "tablingMemberConstituency" : {"_value" : "Islington South and Finsbury"} , "tablingMemberPrinted" : [{"_value" : "Emily Thornberry"} ], "uin" : "194343"} , {"_about" : "http://data.parliament.uk/resources/1648145", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1648145/answer", "answerText" : {"_value" : "

Through the Rape Review, we are making sustained progress on our ambitions to increase the number of referrals to the CPS, CPS charges, and Crown Court receipts for adult rape cases back to 2016 levels. 2016 levels are an ambitious target – convictions in 2016 were 30% higher than in 2010 under Labour.

According to the latest quarter of data we have either exceeded or are on track to exceed each ambition:

o There were 1,079 total police referrals, more than double the 2019 quarterly average of 461 and up by 41% compared to the 2016 quarterly average of 766. (Oct-Dec 2022)

o There were 472 CPS charges, nearly double the 2019 quarterly average of 244, just 12% below the 2016 quarterly average of 538. (Oct-Dec 2022)

o The number of adult rape Crown Court receipts continued to increase in the first quarter of 2023 with 605 Crown Court receipts, exceeding our ambition of 553. (Jan- March 2023)

In June 2021, we published the End-to-End Rape Review Report and Action Plan and we are seeing steady and sustained progress on our ambitions to increase the number of adult rape cases being referred, charged, and received at the Crown Court.

According to the latest data (Jul – Sep 2022) we are on-track to reach our ambition for all three metrics:

  • There were 999 total police referrals, up by 117% compared to the quarterly average in 2019 (461), when the Rape Review was commissioned.

  • There were 473 CPS charges, up by 94% compared to the 2019 quarterly average (244).

  • There were 467 Crown Court receipts, up by 102% compared to the 2019 quarterly average (231).

We have also seen increases in the number of people prosecuted for an adult rape offence, which went up by 15% over the past year (from 1,193 in the year to June 2021 to 1,371 in the year to June 2022) and by 62% compared to the pre-pandemic year (from 848 in the year to June 2019).

We are determined to go further for rape victims so that more victims of rape get the justice they deserve and more rapists are taken off our streets.

We regularly publish updates on the progress we are making through the six-monthly progress reports. We have published three of these reports (in December 2021, June 2022, and December 2022), with the next report due to be published in June 2023. The December 2022 Progress Report was already announced in the House through a written ministerial statement.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4362", "label" : {"_value" : "Biography information for Edward Argar"} } , "answeringMemberConstituency" : {"_value" : "Charnwood"} , "answeringMemberPrinted" : {"_value" : "Edward Argar"} , "dateOfAnswer" : {"_value" : "2023-02-27", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-02-27T15:44:46.37Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2023-02-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Rape: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Justice, what recent assessment he has made of the implications for his policies of trends in the level of prosecutions for rape; and if he will make a statement.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4651", "label" : {"_value" : "Biography information for Dan Carden"} } , "tablingMemberConstituency" : {"_value" : "Liverpool, Walton"} , "tablingMemberPrinted" : [{"_value" : "Dan Carden"} ], "uin" : "147341"} , {"_about" : "http://data.parliament.uk/resources/1567607", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1567607/answer", "answerText" : {"_value" : "

The Crown Prosecution Service (CPS) does not hold any data which shows the number of defendants prosecuted for, or convicted of, the offence of rape. However, management information is held showing the number of defendants by prosecution outcome, flagged as involving offences of rape since 1st January 2010 to the end of September 2022 by quarter. The tables below show the number of completed prosecutions and convictions in rape flagged cases.

The Crown Prosecution Service (CPS) does not hold any data which shows the number of suspects charged with the offence of rape. However, management information is held showing the number of suspects charged, by sex, flagged as involving allegations of rape where the CPS authorised a charge and a prosecution has commenced in each of the last three years ending March 2022. The table below shows the number of decisions to charge, in rape flagged cases by the sex of suspects, where this has been identified.

In June 2021, we published the End-to-End Rape Review Report and Action Plan. During that review, we took a hard and honest look at how the entire criminal justice system deals with rape and in too many instances it simply has not been good enough. We apologised at the time for this and committed to delivering real improvements to transform support for victims, and working with the police and the CPS to more than double the number of adult rape cases being charged and reaching court by the end of this Parliament.

Since June 2021, we have made significant progress in delivering actions to change the system for the better. Whilst the majority of actions are on track and have been delivered in the timescales we intended, there is much work still to do to ensure that the actions are having the impact they need to.

We are committed to going further and pushing harder on our actions so that we can drive bigger impacts, deliver wider system change and crucially, deliver justice for victims of rape and sexual abuse. We are:

    • Establishing suspect-focused rape investigations – known as Operation Soteria – across five police forces, and will expand this to 14 more by September, with a national rollout completed by June 2023.

    • Expanding pre-recorded cross-examination (Section 28) for victims of sexual violence and modern slavery in Crown Courts nationwide – with this vital measure now available in almost half of all Crown Courts (37 locations). The Government is committed to rolling it out nationwide by September.

    • Expanding support for victims. This includes creating a national 24/7 support line for victims of rape and sexual abuse, so that every victim can access support whenever and wherever they need it. We are using additional ringfenced funding to increase the number of Independent Sexual and Domestic Violence Advisors (ISVAs and IDVAs) by 300, to over 1000 by 2024/25 - a 43 percent increase over the next three years.

    • Publishing the CJS delivery data dashboard quarterly for adult rape which brings together local data from across the system in one place for the first time, allowing us to increase transparency, increase understanding of the justice system and support collaboration, especially at a local level.

    • Announcing a pilot of enhanced specialist sexual violence support in the Crown Court. This is aimed squarely at doing better by rape victims, giving them the support they need to stay engaged in the process and get the justice they deserve.

These actions are starting to have an impact on the system, though there is still more progress to be made:

      • Rape cases referred by the police to the CPS have increased in the last quarter of 2021 by 76% from the quarterly average in 2019, when the Rape Review was commissioned.

      • Rape cases charged by the CPS in the last quarter of 2021 have also increased by 38% from the quarterly average in 2019.

      • Rape convictions are increasing: there was a 67% increase in the number of people convicted for rape offences between 2020 and 2021.

The average number of days for adult rape from CPS charge to the case being completed continued to fall by 38 days – roughly 5 weeks - since the peak in June 2021 – down from 457 days to 419 in October - December 2021.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4369", "label" : {"_value" : "Biography information for Tom Pursglove"} } , "answeringMemberConstituency" : {"_value" : "Corby"} , "answeringMemberPrinted" : {"_value" : "Tom Pursglove"} , "dateOfAnswer" : {"_value" : "2022-07-08", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2022-07-08T13:02:07.907Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2022-07-01", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Rape: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask to the Secretary of State for Justice, what progress he has made on the objective of ensuring the number of rape cases being referred by the police and going to court is on track to be at the level reached in 2016 by the end of the Parliament; and if he will make a statement.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4512", "label" : {"_value" : "Biography information for Caroline Ansell"} } , "tablingMemberConstituency" : {"_value" : "Eastbourne"} , "tablingMemberPrinted" : [{"_value" : "Caroline Ansell"} ], "uin" : "28897"} , {"_about" : "http://data.parliament.uk/resources/1485233", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1485233/answer", "answerText" : {"_value" : "

A key part the Attorney General’s role as head of the profession is meeting regularly with the leaders of the Professional bodies to discuss matters of relevance within the criminal justice system including the Chair of the Bar Council, the Chair of the Criminal Bar Association, the President of the Law Society and the Bar Circuit Leaders. These valuable and productive meetings enable the Law Officers to understand the issues affecting front-line practitioners, so that they are able to articulate their concerns to ministerial colleagues to ensure that in the development of government policy, the views of the profession are reflected and understood.

Agendas for these meetings are prepared so as to allow flexibility, in order to allow for discussion of topical issues. Such issues include the views of practitioners on the Crown Court backlog, government initiatives such as the roll out of s.28 and how we are working together to improve the system performance in relation to rape cases.
