Operation Early Dawn is an existing contingency measure to ensure sufficient governance exists between HMPPS, the Prison Escort Custody Service (PECS) and HMCTS to maintain the effective management of prisoner transfers between courts and custody.<\/p>

<\/p>

It involves an operational assessment being made each morning by HMPPS on which prisoners can be transferred from police cells and taken to courts to ensure there is a safe and secure location if remanded to custody.<\/p>

At least a partial collection is made from every Police Station which allows Police (and HMCTS for subsequent collections) to identify priority collections, including those who pose a higher risk.<\/p>

In prisons where we have crowding in place, a rigorous cell certification process is undertaken that ensures the use of cells is subject to formal assessment of safety and decency.<\/p>

We continue to pursue the package of longer-term measures the Lord Chancellor announced on 16 October 2023 to reform the justice system and continue to address the prison capacity challenges. The measures include: the extension of the Early Removal Scheme, introducing a presumption to suspend sentences of 12 months or less, curtailing the licence period for IPP sentences and extending the use of Home Detention Curfew. On 11 March, the Lord Chancellor announced the next steps in our plan, to allow us to go further and faster in removing foreign national offenders (FNOs). This includes expediting prisoner transfers with our priority partners such as Albania, and the creation of a new taskforce across the Home Office and Ministry of Justice to change the way we process FNO cases radically.<\/p>

To meet pressing demand, we are building c.20,000 modern, rehabilitative prison places \u2013 the biggest prison build programme since the Victorian era. We have already delivered c.5,900 of these, including through our two new 1,700 places prisons, HMP Five Wells and HMP Fosse Way, and c.590 Rapid Deployment Cells across 11 sites. By the end of 2025, we are on track to have delivered around 10,000 places in total.<\/p>

In certain circumstances, there is persuasive evidence that community orders and suspended sentence orders are more effective than sentences of immediate custody in reducing reoffending. In the Sentencing Bill, currently before Parliament, the Government is introducing a presumption to suspend short custodial sentences. The offender would then serve their sentence in the community.<\/p>

In terms of the remand and recall populations, we are working with our partners across the criminal justice system to safely manage the system and protect the public. This includes raising awareness of, and removing barriers to, the use of bail where appropriate as an alternative to remanding defendants in custody, including on 2 August 2023 publishing a new EM Court Bail Protocol. For recall, we have issued guidance to probation staff to ensure all safe alternatives to recall are considered before a decision is taken, and we have re-invigorated the Secretary of States power, under Section 255(B) of the Criminal Justice Act 2003, to release recalled offenders following a risk assessed recall review without reference to the Parole Board.<\/p>

Upholding public confidence in the criminal justice system is a core priority and we continue to work to deliver this.
