The statutory guidance on relationships education, relationships and sex education and health education was published in June 2019. In health education, there is a strong focus on mental wellbeing, including a recognition that mental wellbeing and physical health are linked. Emotional literacy at primary and secondary levels is included throughout all 3 subjects, and particularly when covering topics on mental health and wellbeing.<\/p>

<\/p>

Schools have flexibility to design and plan age-appropriate subject content. In health education, the guidance sets out core areas for health and wellbeing for primary and secondary aged pupils; including topics such as mental wellbeing, physical health and fitness, healthy eating, harmful substances, health and prevention and basic first aid.<\/p>

<\/p>

The department is currently working with teachers and schools to determine how support and training for these subjects should be structured. Our programme of support will focus on tools that improve schools\u2019 practice, such as implementation guidance and targeted support; training materials; and resources that teachers need to teach the new subjects effectively.<\/p>

<\/p>

To provide further support for schools to build the capability to identify and promote awareness of mental health needs, the government committed in January 2017 to make available mental health awareness training to one member of staff in all state secondary schools by 2020, and all state primary schools by 2022. The 3 year secondary schools\u2019 mental health awareness training programme started in 2017 and was delivered for the first 2 years by Mental Health First Aid England. In 2019, the Department of Health and Social Care (DHSC) and the Department for Education (DfE) announced that the final year of the secondary school mental health training programme will be delivered by the Anna Freud National Centre for Children and Families. The DHSC are currently considering options on how best to deliver the mental health awareness training in primary schools.<\/p>

<\/p>

The DfE is currently recruiting a provider to develop and deliver a new mental health training programme for senior mental health leads in schools and colleges. We expect to be able to announce the outcome of this process in 2020. Subject to contract award, training delivery will commence from June 2020.<\/p>

The Department is committed to supporting schools to deliver high quality teaching of relationships education, relationships and sex education and health education. The Department has previously announced £6 million, in this financial year, for the development of a programme of support for schools \u2013 the funding will not be distributed to individual schools. Further funding beyond the next financial year is a matter of the forthcoming Spending Review.<\/p>

The Department\u2019s programme of support will focus on tools that improve schools\u2019 practice, such as an implementation guide and targeted support, training materials and resources that teachers need to teach the new subjects. The Department is currently working with lead teachers, non-specialist teachers and schools to develop training materials that are suited to their needs.<\/p>

The Department also encourages schools to start teaching the subjects from September 2019, so that schools can improve methods and share good practice ahead of compulsory teaching from September 2020.<\/p>

The Department has also published guides that set out clearly the nature and content of the subjects, as well as articulate parents\u2019 rights and their involvement in the curriculum. The Department has also previously published FAQs to bust myths on the subjects. This is available here:<\/p>

Teaching about sexually transmitted infections (STIs) including HIV and Aids is included in the current statutory sex and relationships education guidance, which was published in 2000. Schools already teach these topics, often as part of their science curriculum and personal, social, health, and economic education.<\/p>

<\/p>

In teaching about STIs under the new guidance on relationships education, relationships and sex education and health education, schools are free to decide which resources to use and the Department trusts headteachers to make those decisions. The guidance is clear that schools should draw on medically accurate information and set this in the broader context of the subjects as a whole.<\/p>

<\/p>

The Department is committed to supporting schools to teach the new subjects to a high standard. The Department is working with subject experts to ensure schools are supported to improve their practice, including providing easy access to high-quality teaching materials across the requirements for the new subjects.<\/p>

The draft guidance is clear that teaching for these subjects should be in line with pupil need, informed by pupil voice and participation in curriculum development, and should be in response to issues as they arise in the school and wider community. Schools should make sure that staff are equipped to deliver these subjects to a high standard, ensuring that the subjects are well led, effectively managed and planned. Staff have a vital contribution in ensuring these subjects are sensitive to the needs of pupils, for example by having regard to a pupil\u2019s religious background or special educational need and also in ensuring they are embedded as part of a whole school approach.<\/p>

Ofsted inspectors are required to consider pupils\u2019 spiritual, moral, social and cultural development (SMSC) as part of section 5 school inspections. Ofsted\u2019s school inspection handbook, attached, sets out the specific aspects considered under SMSC. It covers a broad range of matters including pupils\u2019 reflectivity; moral and ethical issues; social interaction; participation in the community; and acceptance of and engagement with fundamental British values. Ofsted has recently consulted on new inspection arrangements, and will publish a revised handbook in due course.<\/p>

The Government has no plans to bring forward further legislation relating to relationships education and relationships and sex education (RSE).<\/p>

<\/p>

Schools will be required to have regard to the statutory guidance for the subjects. The draft guidance sets out that when schools consult with parents on their relationships education and RSE policy they should provide examples of the resources that they plan to use when teaching, as this can be reassuring for parents. Schools must also ensure that lessons are appropriate to the age and religious backgrounds of pupils. The Department is supporting schools in the implementation of these subjects and expects this support to include advice on positive engagement with parents.<\/p>

Ofsted reported on the quality of provision for personal, social, health and economic education (PSHE), which covers sex and relationship education, in its 2013 report. The Department is considering what further information on the provision of the new curriculum may be needed. The report can be accessed here:<\/p>

In 2015, the Department published a paper highlighting the impact of the provision of PSHE. The evidence summary provided a high level overview of recent reviews of personal wellbeing education and interventions which could be applied during PSHE lessons, including sex education. Sex education has been compulsory in all maintained secondary schools since 1993. The Sex and Relationship Education Guidance (2000) includes education around abortion, and it is for schools to decide at what age it is appropriate to introduce the topic. The new draft statutory guidance covers intimate and sexual relationships, including choices in relation to pregnancy, and sets out that teaching should provide accurate, impartial information on all options, including keeping the baby, adoption, abortion and where to get further help. It also sets out that secondary pupils should be made aware of legal provisions when relevant topics are being taught. Schools may address abortion in other areas of the curriculum, such as religious education.<\/p>

The content of the draft guidance was subject to a public consultation from July to November 2018 which attracted 11,000 online responses from a wide range of respondents including head teachers, teachers, parents and young people. The Department conducted a consultation on the draft regulations, statutory guidance and regulatory impact assessment for relationships education, relationships and sex education and health education between July and November 2018.<\/p>

The Department was contacted by over 40,000 individuals and organisations during the consultation process. Prior to the consultation, the key decisions were informed by a thorough engagement process. The public call for evidence received over 23,000 responses and the Department engaged directly with 90 organisations, including parents, young people, headteachers, teachers, governors, subject specialists, teaching unions, charities and faith groups.<\/p>

The draft guidance published on 25 February takes account of comments received through the public consultation and engagement with over 90 organisations, including on the right to withdraw from sex education.<\/p>

The Department has no plans to make changes to the guidance published in February, except to the extent that minor corrections are necessary. The Department has committed, however, to publish a supplementary guide for schools to support them in delivering the subjects; this could include further advice on the right to withdraw if that proves necessary.<\/p>

The regulations were debated in the House of Commons on 20 March and were overwhelmingly approved in a division. The Department expects the debate in the House of Lords to take place shortly. The Department is committed to conducting a review of the guidance three years after the new subjects become mandatory in September 2020, and every three years after that. Sex education has been compulsory in all maintained secondary schools since 1993. It is not compulsory in primary schools and will not be once the proposed new subjects of Relationships Education and Relationships and Sex Education become compulsory. The statutory sex and relationships education (SRE) guidance (2000) states that maintained schools must have an up-to-date policy that sets out the school\u2019s approach to sex education and that they should consult their pupils\u2019 parents on this, making the policy available to parents. It is for schools to determine what range of information they provide to parents, but they must have regard to statutory guidance.<\/p>

The Government is now making Relationships Education compulsory for all primary pupils, Relationships and Sex Education (RSE) compulsory for all secondary pupils and Health Education compulsory for all pupils in primary and secondary state funded schools from September 2020.<\/p>

All schools will be required to have in place a written policy for Relationships Education and for RSE. Schools must consult parents in developing and reviewing their policy. Schools should ensure that the policy meets the needs of pupils and parents and reflects the community they serve. Schools should also ensure that the policy sets out the content of the subjects, how the content is taught and who is responsible for teaching it. The draft guidance is clear that schools should ensure that, when they consult parents, they provide examples of the resources they plan to use. Schools should assess each resource that they propose to use to ensure that it is appropriate for the age and maturity of pupils, and is sensitive to their needs.<\/p>

The key decisions on these subjects and the drafting of the guidance were informed by a thorough engagement process. The public call for evidence was launched in December 2017 and received over 23,000 responses from parents, young people and schools. The Department engaged with 90 organisations representing a broad range of views and a broad range of evidence. The revised draft guidance was not shared publicly between the close of the consultation and it being finalised following decisions by Ministers in light of the consultation responses.
