Neighbourhood planning gives communities a powerful set of tools to shape their area. The Written Ministerial Statement of 12 December 2016 (HCWS346) introduced additional protection to neighbourhood plans where all of the following criteria apply:<\/p>

\u2022the written ministerial statement is less than 2 years old, or the neighbourhood plan been part of the development plan for 2 years or less;<\/p>

\u2022the neighbourhood plan allocates sites for housing; and<\/p>

\u2022the local planning authority can demonstrate a 3-year supply of deliverable housing sites against its 5 year housing requirement.<\/p>

The Housing White Paper committed to take forward this important protection in the revised National Planning Policy Framework. Guidance for decision makers on interpreting the Written Ministerial Statement, in light of recent Court judgements, was published on 10 August 2017 https://www.gov.uk/guidance/neighbourhood-planning--2<\/a> (Paragraph: 083) and we will provide further clarification where necessary. Revised guidance will also set out more clearly how the five-year land supply should be calculated.<\/p>

Planning guidance sets out the action an authority should take where a neighbourhood plan comes forward before an up-to-date Local Plan is in place (further details can be found at: http://planningguidance.planningportal.gov.uk/blog/guidance/neighbourhood-planning/what-is-neighbourhood-planning/what-is-a-neighbourhood-plan-and-what-is-its-relationship-to-a-local-plan/<\/a>)

A local planning authority should take a proactive and positive approach, working collaboratively with a parish or town council or a designated neighbourhood forum particularly sharing evidence and seeking to resolve any issues to ensure that the draft neighbourhood plan has the greatest chance of success at independent examination.

Neighbourhood planning, for the first time, gives residents and individuals in businesses the opportunity to produce neighbourhood plans that have real statutory weight in the planning system and grant planning permission for development they want to see through neighbourhood development orders (including community right to build orders). Over 1,100 communities have taken the first steps towards producing a neighbourhood plan for their area and there has been overwhelming support for neighbourhood plans at the 27 local referendums held so far. The first 19 neighbourhood plans are now in force (made) and are part of the development plan for the area.
