The NHS Pension Scheme is generous, and provides good pensions for retirement. A new reformed scheme was introduced in 2015, to ensure the costs are sustainable for the future. The reforms included linking scheme retirement age to an individual\u2019s state pension age, in response to people living healthier, longer lives.<\/p>

Individuals can claim their National Health Service pension earlier than their state pension age, although their benefits will be reduced in value, to account for the fact that they are being paid for longer. This reduction is waived when the scheme accepts a claim for early retirement on ill-health grounds. Where an NHS pension is claimed after state pension age, the reverse applies, and the value of benefits will be increased. The NHS Business Services Authority (NHSBSA) administers the NHS Pension Scheme and operates a complaints process as well as a two-step Internal Dispute Resolution (IDR) procedure. If a complainant has exhausted the IDR process and is not satisfied with the outcome, they may also be able to approach the Pensions Ombudsman.<\/p>

In the 12 months to the end of August 2023, the NHSBSA received 813 complaints, 1,201 IDRs at Stage One, 295 IDRs at Stage Two and 55 cases referred from the Pensions Ombudsman. Some of the complaints the NHSBSA receive may progress to an IDR at Stage One. However, not all IDRs at Stage One originate as complaints as some complainants embark straight onto the IDR process.<\/p>

These complaints need to be seen in the context of the number of members in the NHS Pension Scheme. The 2019/20 Pensions Annual Allowance Compensation Charge reimbursement provision entered in the 2021/22 NHS England accounts is £290 million. The Department recently consulted on a range of pensions measures, including new retirement flexibilities to enable National Health Service staff to work more flexibly up to and beyond retirement age, and changes to scheme rules to address inflation. The Department confirmed on 7 March 2023 that it intends to implement the measures as planned.<\/p>

The changes will remove barriers for experienced staff, including trauma and orthopaedic surgeons, retiring and returning to work and will allow them to draw down some or all of their pension but continue working and building more pension benefits. Staff affected by Annual Allowance (AA) charges will be able to reduce pensionable pay on partial retirement to avoid AA charges without necessarily reducing overall work commitments.<\/p>

We have announced the intention to implement new permanent retirement flexibilities which benefit all staff groups. A consultation on detailed proposals will be published in due course, which is expected to include a new partial retirement option and allowing retired staff to accrue further pension when returning to service.<\/p>

The consultation will also propose the permanent removal of the 16-hour rule which limited the work retired staff could do in the first month upon returning to service. This has been suspended since March 2020 due to the response to the pandemic.
