The Government is committed to facilitating the scrutiny of EU decisions through the House of Commons European Scrutiny Committee and the Lords EU Committee during the transition period.<\/p>

In addition, section 13A of the EU (Withdrawal) Act 2018 (inserted by section 29 of the EU (Withdrawal Agreement) Act 2020) provides that if the House of Commons European Scrutiny Committee or the Lords EU Committee publishes a report which states that EU legislation, including Council Decisions, made during the transition period raises a matter of vital national interest, a Minister must make arrangements for a debate in the relevant House within 14 sitting days.<\/p>

By the end of the year, we will be a fully independent and sovereign country: this means that there will be no alignment with EU law and no jurisdiction of the European Court of Justice.<\/p>

The UK left the European Union on 31 January 2020 and is no longer part of the EU\u2019s decision making machinery so no further scrutiny overrides will require to be reported to Parliament.<\/p>

Between July 2019 to January 2020, 348 Explanatory Memoranda on EU proposals and other documents were submitted for scrutiny.<\/p>

Scrutiny during this period was interrupted by the dissolution of parliament. There were 54 occasions when the Government supported decisions in the EU Council of Ministers before parliamentary scrutiny procedures had been completed.<\/p>

Historically, the largest category of instruments on which overrides have occurred have been fast-moving and sensitive Common Foreign and Security Policy measures including EU restrictive (sanctions) measures and during this period there were 40 occasions when such instruments were adopted before scrutiny could be completed.<\/p>

    Between July and December 2017, 508 EU proposals and other documents were submitted for scrutiny.

    Across both Houses there were 95 occasions when the Government supported decisions in the EU Council of Ministers before the scrutiny procedures had been completed by either one or both Scrutiny Committees.

    In each case the Government explained to the Scrutiny Committees why it was important for the proposal to be supported before clearance had been provided. This period of reporting coincided with the extended period in the new Parliament before the European Scrutiny Committee in the House of Commons was re-appointed on 30 October 2017 and only began meeting again on 13 November to scrutinise documents. As with previous six-monthly periods, the largest category of instrument was fast-moving and sensitive CFSP and EU restrictive measures where there were 66 such instruments adopted before scrutiny could be completed.

    Between January and June 2017, 476 EU proposals and other documents were submitted for scrutiny.<\/p>

    Across both Houses there were 66 occasions when the Government supported decisions in the EU Council of Ministers before the scrutiny procedures had been completed by either one or both Scrutiny Committees.<\/p>

    In each case the Government explained to the Scrutiny Committees why it was important for the proposal to be supported before clearance had been provided. This period of reporting coincided with the dissolution of Parliament where between the prorogation of Parliament between 27 April and 30 June there was no opportunity for scrutiny by the Commons European Scrutiny Committee and the Committee has yet to be reappointed in the new Parliament. However, Lord Boswell of Aynho was reappointed as Chair of the Lords European Union Committee on 21 June and began considering EU documents and EMs submitted to the Committee on 27 June. As with previous six-monthly periods, the largest category of instrument was fast-moving and sensitive CFSP and EU restrictive measures where there were 29 such instruments adopted before scrutiny could be completed. There was also a package of 27 measures on which HM Treasury submitted EMs on the 2017 National Reform Programmes of Member States other than Greece, which were endorsed by Heads of Government at the June European Council without the opportunity for clearance by either Scrutiny Committee.<\/p>

    I refer the noble Lord to my answer of 29 July 2015 (HL1633) which presented the figures for overrides for the period January-June 2015. That answer contained two errors. In a letter dated 16 September 2015 to the Chairs of the two Scrutiny Committees, the Minister of State for Foreign and Commonwealth Affairs, my right hon. Friend the Member for Aylesbury (Mr Lidington), undertook to correct the errors when providing figures for the period July-December 2015. One Foreign and Commonwealth Office override on the Council decision extending the mandate of the EU Special Representative in Bosnia and Herzegovina had been counted twice. This brings the overall total down from 90 to 89. The total in the House of Lords (54) is unchanged since the Committee cleared that proposal before adoption, but it does reduce the number declared for the House of Commons from 86 to 85. The answer also stated that the 39 measures (the largest category of the total) were the Common Foreign and Security Policy restrictive measures. A recalculation has shown the figure to be 38. The earlier answer also highlighted an unresolved issue of whether an override needed to be recorded against a Commission Communication on the Paris Protocol (\u2018A Blueprint for tackling Global Climate Change beyond 2020\u2019) because discussion with the European Scrutiny Committee had at that stage not been concluded.
