It is unacceptable that protests should disrupt the hard-working people going about their daily business.<\/p>

The Police, Crime, Sentencing and Courts Act 2022 is already in force. This raised the maximum penalty for wilful obstruction of the highway to 6 months\u2019 imprisonment, a level 3 fine on the standard scale, or both.<\/p>

The Public Order Act 2023, which received Royal Assent on 2 May, has also introduced new measures to improve the police\u2019s ability to respond to highly disruptive protests. This includes the offence of interference with the use or operation of key national infrastructure, which, carries a maximum penalty of 12 months\u2019 imprisonment, an unlimited fine, or both on indictment or a maximum penalty of and, six months\u2019 imprisonment, an unlimited fine, or both, respectively on summary.<\/p>

In addition, Parliament has approved a Statutory Instrument providing greater clarity to law enforcement on when conditions can be imposed on public processions causing serious disruption to the life of the community.<\/p>

We will continue to work closely with the police going forwards to make sure they are able to make full use of these powers.<\/p>

Ahead of the commencement of section 9 of the Public Order Act 2023, the College of Policing and the Crown Prosecution Service are updating relevant public order guidance and training to reflect the inclusion of the offence of interference with access to or provision of abortion services.<\/p>

In accordance with human rights obligations, these organisations are required to consider the rights provided under Article 9 (freedom of thought, religion and belief), Article 10 (freedom of expression) and Article 11 (freedom of association and assembly) of the European Convention on Human Rights, recognising that they are qualified and can sometimes be infringed upon to uphold other rights.<\/p>

The freedom to peacefully protest across the country is a fundamental right that this Government is proud to support. Most protest activity in this country does not require a police response and we expect that to continue. The public order measures in the PCSC Bill are targeted at non-violent protests that cause serious disruption to the lives of others.<\/p>

Face coverings can be worn in public places for a variety of legitimate reasons. In the context of a public order situation, where face coverings are being worn with the express intention of concealing identity, section 60AA of the Criminal Justice and Public Order Act 1994 enables a police officer in uniform to require any person to remove any item which the officer reasonably believes is being worn wholly or mainly for the purpose of concealing their identity. Section 60AA also enables a police officer in uniform to seize any item which they reasonably believe any person intends to use to conceal their identity.<\/p>

A refusal to comply with a direction under this section of the Act is punishable by a fine of up to £1,000 and/or one month\u2019s imprisonment.<\/p>

These powers only apply in the locality and for the period for which an authorisation under section 60 or section 60AA of the Act has been given by a police officer of the rank of inspector or above. An inspector\u2019s authorisation lasts for a maximum period of 24 hours, unless a police officer of the rank of superintendent or above authorises their use for a further 24 hours.<\/p>

The police have a range of powers to manage the impacts of marches and demonstrations. Under the Public Order Act 1986, chief officers may impose conditions on assemblies and public processions to prevent serious public disorder, serious damage to property, or serious disruption to the life of the community.

The Government has no plans to bring forward any further legislation on this issue. We will continue to work with the police to ensure they have the powers they need to maintain public order.<\/p>
