The government has recently consulted on potential future measures to mitigate carbon leakage risks, including the potential for a UK Carbon Border Adjustment Mechanism (CBAM). The consultation closed on 22 June 2023, and the government will respond to the consultation in due course.<\/p>

<\/strong><\/p>

In May 2023, the EU formally adopted their EU CBAM Regulation, which will start with a transitional (reporting) phase from 1 October 2023. The EU CBAM charge will not come in until 1 January 2026.<\/p>

<\/p>

Full details of the EU CBAM will be known when the EU adopt the required implementing and delegated acts. UK officials are continuing to closely monitor this process and are waiting to see these before building a full understanding of potential impacts on UK businesses and any interactions with domestic policy<\/p>

The EU regulatory regime for vehicle CO\u2082 emissions was retained in UK law following the end of the transition period. Two SIs, the Road Vehicle Carbon Dioxide Emission Performance Standards (Cars and Vans) (Amendment) (EU Exit) Regulations 2020 and the New Heavy Duty Vehicles (Carbon Dioxide Emission Performance Standards) (Amendment) (EU Exit) Regulations 2020, entered into legal effect at that same point, correcting the EU legislation to work in a UK-only scenario.<\/p>

Finland, Denmark, Germany and Portugal have all set out aspirations or proposals to achieve net zero greenhouse gas emissions or net zero carbon emissions by 2050. However, none has yet enshrined such a commitment in law.<\/p>

Finland has stated its intention to achieve net zero carbon emissions by 2035. Denmark has set out an intention to achieve net zero greenhouse gas emissions by 2050 in its climate plan \u2018Together for a Greener Future\u2019. Germany is currently debating a draft climate law which proposes a target for net zero greenhouse gas emissions by 2050. Portugal has approved a roadmap to achieve net zero carbon emissions by 2050.<\/p>

The UK was the first major economy to legislate for a net zero target. The action we are taking in setting this target will continue our proud tradition of climate leadership.<\/p>

The EU Member States that have targets for net zero greenhouse gas emissions in legislation are Sweden (by 2045) and the United Kingdom (by 2050). France is currently in the process of legislating for a 2050 net zero greenhouse target.<\/p>

In addition, a range of Member States have adopted or are currently publicly considering adopting plans for net zero carbon or greenhouse gas emissions by 2050, and in some cases have stated their intention is to legislate for a target. These include Denmark, Germany, and Portugal and Finland. Other Member States with plans to significantly reduce emissions by 2050 include the Netherlands, which has a law to reduce greenhouse gas emissions by 95%, and Spain, which has a draft law proposing an at least 90% reduction (in both cases the reduction is compared to 1990).<\/p>

The EU is also considering adopting a bloc-wide net zero 2050 target, with a large majority of Member States, including the UK, supporting a net zero EU target by 2050 at the June European Council this year.
