I refer the Noble Baroness to the oral answer given by the Secretary of State for Work and Pensions, the Rt.Hon. Iain Duncan Smith, Official Report, 8 December 2014, column 633. He set out how the Department for Work and Pensions will be doing much more to raise awareness of Short Term Benefit Advances (STBAs) as recommended by the All-Party Parliamentary inquiry and others, including the Social Security Advisory Committee. This will include providing more information to claimants about STBAs online and in Jobcentres. Staff guidance on STBAs will also be updated and staff reminded of the process for considering an STBA.<\/p>

<\/p>

A key part of the STBA process is a discussion between the claimant and the Decision Maker to consider the circumstances of the request and make an informed discretionary decision about the claimant\u2019s needs. Such a discussion needs to be had with the claimant and cannot be done online or with a third party.<\/p>

<\/p>

Benefits are normally paid in arrears and where the Department can pay any benefit due to the claimant it does. Where an STBA can be paid it is usually paid the day after it is first requested by the claimant.<\/p>

<\/p>

The Government believes the current system for claiming STBAs is simple. All claimants need to do is mention to staff that they will not be able to manage until their payment is due and the STBA process will start. However, the Government has accepted the need to raise awareness of STBAs as set out above.<\/p>

<\/p>

The Government has made improvements to the hardship process. The Government has advocated a risk-based approach to \u201cpolitically exposed persons\u201d domestically, through negotiations on the Directive.<\/strong><\/p>

All known new drugs, which include new antibiotics, coming onto the United Kingdom market are considered as part of the process for determining whether they can be added to the list of high cost drugs that are reimbursed outside of national prices. Burma remains the main source of drugs in the region and is the world\u2019s second largest producer of opium poppy, which along with illicit trade of jade, provides significant sources of income that have helped fuel Burma\u2019s internal conflicts. We are aware of plans for improved cooperation between the nations of the Mekong region, including Burma, to tackle the illicit drugs trade. HM Courts & Tribunals Service, First-tier Tribunal Special Educational Needs and Disability (FtT SEND) considers appeals from the parents of children with special educational needs or from young people with special educational needs, against the decisions of Local Authorities where the parent or the young person cannot reach agreement with the Local Authority about how those needs will be met. FtT SEND also considers parents' or young persons\u2019 claims of disability discrimination in schools. Although the tribunal deals with appeals against local authority placements it does not deal with appeals relating to the admission processes for children with SEN in any schools nor does it deal with appeals relating to the education within schools, of children with SEN. HMCTS is therefore unable to provide the specific information that has been requested and has no role in compliance.<\/p>

<\/p>

Appeals to the FtT SEND are against Local Authorities rather than the individual school or educational establishment. Appeals can be made for a number of reasons including, for example, where the Local Authority has refused to undertake an assessment of the child's or young person\u2019s needs or where a parent disagrees with the school named in the Education, Health and Social Care Plan provided by the Local Authority. I refer the Noble Baroness to the oral answer given by the Secretary of State for Work and Pensions, the Rt.Hon. Iain Duncan Smith, Official Report, 8 December 2014, column 633. He set out how the Department for Work and Pensions will be doing much more to raise awareness of Short Term Benefit Advances (STBAs) as recommended by the All-Party Parliamentary inquiry and others, including the Social Security Advisory Committee. This will include providing more information to claimants about STBAs online and in Jobcentres. Staff guidance on STBAs will also be updated and staff reminded of the process for considering an STBA.<\/p>

<\/p>

A key part of the STBA process is a discussion between the claimant and the Decision Maker to consider the circumstances of the request and make an informed discretionary decision about the claimant\u2019s needs. Such a discussion needs to be had with the claimant and cannot be done online or with a third party.<\/p>

<\/p>

Benefits are normally paid in arrears and where the Department can pay any benefit due to the claimant it does. Where an STBA can be paid it is usually paid the day after it is first requested by the claimant.<\/p>

The Government believes the current system for claiming STBAs is simple. All claimants need to do is mention to staff that they will not be able to manage until their payment is due and the STBA process will start. However, the Government has accepted the need to raise awareness of STBAs as set out above.<\/p>

The Government has made improvements to the hardship process.
