The Government is aware of the concerns raised by representatives of the research community about amendments to the proposed EU General Data Protection Regulation that could prevent health research involving personal data from taking place. These concerns centre on amendments to the proposed Regulation which have been agreed by the Civil Liberties, Justice and Home Affairs (LIBE) committee of the European Parliament.<\/p>

Negotiations on the EU data protection framework are ongoing and the final text will be subject to the co-decision of the Council of the European Union and the European Parliament under the ordinary legislative procedure. However, negotiations have yet to reach the \u2018trialogue\u2019 stage as the Council of the EU has not yet agreed a general approach on the text.<\/p>

The Government\u2019s view is that the ability of researchers to process personal data in the way that they are legitimately able to do so at present must be preserved. NOMS policy is that prisoners are only permitted very restricted access to the Internet for resettlement purposes and in a closely controlled and managed environment.<\/p>

If found accessing the Internet without the permission of staff, prisoners are dealt with robustly and can be referred to the police or charged with an offence against the Prison Rules.<\/p>

NOMS does not centrally record the number of prisoners who have accessed the Internet without permission. The National Offender Management Service (NOMS) takes the issue of all contraband in prisons extremely seriously and deploys a comprehensive range of robust searching and security measures to detect items of contraband both at the point of entry to the prison and concealed within the prison. These include drug detection dogs, procedures to tackle visitors and others who seek to smuggle drugs and phones into prisons, and mobile phone detection technology. NOMS has rolled out a networked IT intelligence system and provided prisons with short range portable mobile phone blockers which will help prisons prevent prisoners using mobile phones, which are often associated with drug supply.<\/p>

<\/p>

The success of NOMS drug strategy is illustrated by the reduction of drug misuse - as measured by the random mandatory drug testing programme - which has declined by 17.0 percentage points over the past 17 years. Positive rates were 24.4% in 1996/7 and 7.4% in 2013/14, despite the fact that prisoners are being tested for a greater range of drugs.<\/p>

The government recently introduced an amendment to the Criminal Justice and Courts Bill to expand prisons' powers to test prisoners for non-controlled drugs. Grave robbing is an appalling offence, though instances are fortunately rare. The theft of items from graves is a heartless and callous crime which can have a devastating impact on bereaved relatives and friends. If the offenders responsible are detected they can expect to feel the full force of the law.<\/p>

The Ministry of Justice Court Proceedings Database holds information on defendants proceeded against, found guilty and sentenced for criminal offences in England and Wales. However, not all offences are individually reported within the centrally held data. Offences of grave robbery are reported as part of a wider group of offences and cannot be separately identified from other offences under the Theft Act. The Government is absolutely clear that abusive and threatening behaviour online \u2013 whoever the target - is totally unacceptable.<\/p>

<\/p>

There is a number of offences which may be committed by those abusing others on social media. Internet communication which is grossly offensive or menacing may fall under section 127 of the Communications Act 2003. Sending indecent, grossly offensive or threatening material to another with the purpose of causing distress or anxiety to a person to whom the material is communicated, including by means of the internet, is also an offence under the Malicious Communications Act 1988.<\/p>

<\/p>

Internet abuse could also amount to an offence under the Protection from Harassment Act 1997 if its distribution is carried out as part of a \u2018course of conduct\u2019 which alarms a person or causes distress. Under section 4 of that Act, it is also an offence to pursue a course of conduct that repeatedly puts someone in fear of violence.<\/p>

<\/p>

Changes to the law being taken forward in the Criminal Justice and Courts Bill will increase the maximum penalty for offences under the Malicious Communications Act 1988 to 2 years imprisonment, and extend the time within which prosecutions under section 127 of the Communications Act 2003 may be brought, to up to three years, as opposed to the current six month limit.<\/p>

<\/p>

A new criminal offence of disclosing private sexual photographs and films without the consent of the individual appearing in the photograph or film and with intent to cause them distress is also being created in the Criminal Justice and Courts Bill. This is intended to deal with the behaviour commonly known as \u2018revenge porn\u2019. The offence will carry a two year maximum prison sentence.<\/p>

As of 1 October 2014 there were 55 offenders in England and Wales who are serving a life sentence without a minimum term, thereby requiring them to remain in custody for the rest of their lives with no possibility of parole.<\/p>

50 of the prisoners were being held in Prison Service establishments, whilst the remaining five were detained in secure hospitals under the terms of the Mental Health Act 1983.<\/p>
