The Crown Prosecution Service (CPS) does not maintain a central record of the number of cases in which a defendant has been charged with, or prosecuted for a criminal offence where it subsequently becomes known that their actions were the result of their being a victim of modern slavery

The CPS has published clear legal guidance which recognises the principle of non-prosecution of victims of trafficking or slavery. It has delivered training on the steps to be taken, where there is a reason to believe that a suspect or defendant in a criminal case might be a victim. In those circumstances, the prosecutor will consider what further evidence or information might be required and will review whether the prosecution should proceed or not. The guidance sets out that where there is sufficient evidence that the accused is a victim and the conditions provided for in section 45 of the Modern Slavery Act 2015 are met, the case should not be charged or proceeded with.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4517", "label" : {"_value" : "Biography information for Lucy Frazer"} } , "answeringMemberConstituency" : {"_value" : "South East Cambridgeshire"} , "answeringMemberPrinted" : {"_value" : "Lucy Frazer"} , "dateOfAnswer" : {"_value" : "2019-07-25", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-07-25T12:33:41.567Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "88"} , "answeringDeptShortName" : {"_value" : "Attorney General"} , "answeringDeptSortName" : {"_value" : "Attorney General"} , "date" : {"_value" : "2019-07-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Slavery: Victims"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Attorney General, what estimate his Department made of the number of victims of modern slavery who have been charged with a criminal offence committed in connection to their being a victim of slavery.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4493", "label" : {"_value" : "Biography information for Richard Burgon"} } , "tablingMemberConstituency" : {"_value" : "Leeds East"} , "tablingMemberPrinted" : [{"_value" : "Richard Burgon"} ], "uin" : "278560"} , {"_about" : "http://data.parliament.uk/resources/1139568", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1139568/answer", "answerText" : {"_value" : "

The Crown Prosecution Service (CPS) does not maintain a central record of the number of prosecutions of defendants charged with offences of keeping a brothel or of controlling prostitution. This information could only be obtained by a manual examination of CPS case files, which would incur disproportionate cost.

While the CPS does not collect data on defendants prosecuted by specific offence or the outcome of any prosecution, information is available for the number of offences concerning the keeping or management of brothels and controlling prostitution, in which a prosecution commenced at magistrates’ courts. The table below shows the number of these offences recorded on the CPS’s Case Management System in each financial year over the last ten years.

GLD represents most, but not all, Government Departments in litigation. In addition, during parts of the period covered by the table, a small number of Departments (that GLD now acts for in litigation) handled their own litigation (including inquests).

Rape and serious sexual offences are horrific crimes, which can have a significant and profound impact on victims.

I recognise that there is real current concern around the criminal justice response to rape and serious sexual offences. The Government’s Review provides an opportunity to identify areas, from the beginning to the end of the criminal justice process, where the police, CPS and HM Courts and Tribunals Service can improve practice and outcomes in cases involving these offences. The CPS will work with partners across the criminal justice system to address any issues that are highlighted as a result of the Review.

All those involved in the Review, including the AGO and the CPS, are committed to ensuring that the Review is conducted with the requisite degree of openness and independence as to enable the public to have full confidence in its final findings.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4517", "label" : {"_value" : "Biography information for Lucy Frazer"} } , "answeringMemberConstituency" : {"_value" : "South East Cambridgeshire"} , "answeringMemberPrinted" : {"_value" : "Lucy Frazer"} , "dateOfAnswer" : {"_value" : "2019-07-09", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-07-09T14:52:47.887Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "88"} , "answeringDeptShortName" : {"_value" : "Attorney General"} , "answeringDeptSortName" : {"_value" : "Attorney General"} , "date" : {"_value" : "2019-07-02", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Sexual Offences: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Attorney General, how he will ensure that the Criminal Justice Board review of how rape and sexual violence cases are handled across the criminal justice system provides independent scrutiny of CPS case handling.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/458", "label" : {"_value" : "Biography information for Ann Coffey"} } , "tablingMemberConstituency" : {"_value" : "Stockport"} , "tablingMemberPrinted" : [{"_value" : "Ann Coffey"} ], "uin" : "272118"} , {"_about" : "http://data.parliament.uk/resources/1135927", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1135927/answer", "answerText" : {"_value" : "

Progress is being made on the Serious Fraud Office (SFO) investigation into allegations of corruption in the conduct of business by British American Tobacco Plc, its subsidiaries and associated persons.
