During the financial year 2016/17, the SFO recorded expenditure of £21,943 for hosting its secure communications infrastructure. This supports one-off questionnaires for victims of specific, alleged frauds and secure communications with overseas partners, as well as the secure reporting tool.<\/p>

In addition, £450 for administration costs was incurred. This was for user licence fees attributable to accessing the secure reporting tool.<\/p>

These totals do not include any staff costs as this work is done alongside normal duties. The SFO does not hold accurate information on the time spent administering the system.<\/p>

<\/p>

Since its introduction, the SFO has continued to improve the functionality of the reporting tool to assist people in making more comprehensive reports about alleged fraud, bribery or corruption. The reporting tool also has the advantage of allowing referrers to make a report anonymously and in confidence without fear of reprisal. It is the main source of people reporting offences to the SFO. It has improved the way in which offences are reported by simplifying the method of doing so. It has also increased the security of those communications. In addition, it offers guidance on other organisations to contact for assistance if the matter falls outside the SFO\u2019s remit.<\/p>

Domestic confiscation orders, once obtained are enforced by Her Majesty\u2019s Courts and Tribunals Service (HMCTS). The Crown Prosecution Service (CPS) assists in the enforcement process in situations where it can add value, such as by managing restraint orders, seeking the appointment of enforcement receivers and, in relation to assets held overseas, seeking assistance from other jurisdictions. It is the Lead Enforcement agency in these cases. When the CPS can no longer add value to the enforcement of a confiscation order, the responsibility for enforcement reverts to HMCTS and the CPS no longer monitors its progress.<\/p>

The Crown Prosecution Service (CPS) does not maintain a central record of the number of people who have been charged with, and prosecuted for, selling illegal tobacco. This information could only be obtained by examining CPS case files, which would incur disproportionate cost.<\/p>

The Tobacco Products Duty Act 1979 relates to the excise duty on tobacco products. Section 8G(4) and 8H(6) of the act was inserted by the Finance Act 2000 and creates the offences of (a) possess, transport or display unmarked tobacco products otherwise than as described and (b) selling, offering to sell or otherwise deals in unmarked tobacco products; or suffers premises to be used for the sale of unmarked tobacco products. In these sections unmarked products mean tobacco products that are subject to fiscal marking but do not carry compliant duty-paid fiscal mark.<\/p>

Although it is not possible to identify the number of people charged with particular offences, records are held showing the overall number of offences in which a prosecution commenced in the Magistrates\u2019 courts. The table below shows the number of offences, rather than defendants, charged by way of the Tobacco Products Duty Act 1979. A single defendant may be charged with more than one offence. Data are only available since 2011-12. Prior to this date, prosecutions under this legislation were carried out by the Revenue and Customers Prosecution Office (RCPO).<\/p>

The Customs and Excise Management Act 1979 relates to the collection and management of the revenues of custom and excise. Prosecutions under section 170(1)(b) for being knowingly concerned in \u2018carrying, removing, depositing, harbouring, keeping or concealing or in any manner dealing\u2019 with excise goods and the offence of fraudulent evasion of duty under s170(2) can include offences involving tobacco products but also other products.<\/p>

CPS data does not dis-aggregate the overall number of these offences in which a prosecution commenced in the Magistrates\u2019 courts. This information could only be obtained by examining CPS case files, which would incur disproportionate cost.<\/p>

Some offences in relation to the unlawful sale of tobacco products are prosecuted by trading standards departments and would not be recorded in CPS data.<\/p>
