The Crown Prosecution Service (CPS) maintains a central record of the outcomes of completed prosecutions, as a count of the number of defendants finalised, and collates the data collected by quarter. Each non-conviction (or ‘unsuccessful’) outcome is allocated a reason, indicating the principal reason the defendant was not convicted. The CPS also collects data which reports the number of prosecuted defendants allocated to twelve Principal Offence Categories.

The table below shows the number of non-convictions due to victim issues by Principal Offence Category in each quarter from Q3 2018-19 (October to December 2018) to Q4 2019-20 (January to March 2020).

The Crown Prosecution Service (CPS) collects finalised prosecutions data showing the sex of defendants for cases flagged as involving domestic abuse. Some, more limited, information is also available showing the identified relationship between defendant and complainant and whether the relationship is between people of the same or different sex.

The table below shows the number of defendants prosecuted for domestic abuse where a relationship was identified as same sex (partner, ex-partner, spouse/civil partner or former spouse/civil partner), during each of the last ten years. It also highlights the number of defendants where the relationship has been recorded. This data is limited, which results in the number of defendants with an identified relationship being under-recorded.

The main criminal offence under the Coronavirus Act relates to potentially infectious persons who refuse to co-operate with the police or public health officers, when they are required to be screened for COVID-19.

There have been no successful prosecutions of any offence created by the Coronavirus Act 2020.

The table below shows the number and proportion of prosecution outcomes resulting in a non-conviction due to victim or complainant issues in each quarter from Q3 2018-19 (October to December 2018) to Q4 2019-20 (January to March 2020).

Over the last financial year 2019-20 the charging rate increased by over 10% and there was a 6.2% rise in the volume of rape cases proceeding to prosecution following a decision to charge. Although this is a promising trend which the CPS is seeking to maintain, there is clearly more to be done.

The reasons behind the recent declines in prosecutions are complex and a whole system approach is necessary to address them. There is ongoing work to improve the handling of these sensitive cases and narrow the disparity between offences reported and cases going to court.

In July the CPS published its own rape strategy, the first of its kind for any department. There is also an ongoing cross-Government review of the criminal justice response to rape. This is examining evidence across the system about the causes of the falls in outcomes for rape and identifying solutions to reverse the trend. The CPS is actively engaged in this review and will address any issues raised honestly and openly.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4116", "label" : {"_value" : "Biography information for Sir Michael Ellis"} } , "answeringMemberConstituency" : {"_value" : "Northampton North"} , "answeringMemberPrinted" : {"_value" : "Michael Ellis"} , "dateOfAnswer" : {"_value" : "2020-09-28", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2020-09-28T08:31:53.63Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "88"} , "answeringDeptShortName" : {"_value" : "Attorney General"} , "answeringDeptSortName" : {"_value" : "Attorney General"} , "date" : {"_value" : "2020-09-21", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Rape: Prosecutions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Attorney General, with reference to CPS data summary Quarter 4 2019-2020, what recent assessment he has made of the reasons for the decline in rape prosecutions.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/411", "label" : {"_value" : "Biography information for Mr Barry Sheerman"} } , "tablingMemberConstituency" : {"_value" : "Huddersfield"} , "tablingMemberPrinted" : [{"_value" : "Mr Barry Sheerman"} ], "uin" : "92683"} , {"_about" : "http://data.parliament.uk/resources/1234953", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1234953/answer", "answerText" : {"_value" : "
