The Government is acutely aware of the importance of ensuring that vulnerable people such as children and young people have access to justice.

The Lord Chancellor’s Guidance on Exceptional Funding sets out some of the points that caseworkers at the Legal Aid Agency should take into account when deciding any application for civil legal aid exceptional funding, including those from children and young people. These factors include the importance of the issues at stake, the complexity of the procedures and the capability of the applicant to present their case effectively. The age of the child or young person applicant is one factor which caseworkers will always consider and the Guidance sets out specific questions which may be relevant in the case of a child applicant.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/1496", "label" : {"_value" : "Biography information for Shailesh Vara"} } , "answeringMemberConstituency" : {"_value" : "North West Cambridgeshire"} , "answeringMemberPrinted" : {"_value" : "Mr Shailesh Vara"} , "dateOfAnswer" : {"_value" : "2015-02-10", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2015-02-10T12:52:58.197Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2015-02-03", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Legal Aid Scheme"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Justice, what criteria are applied to children and young people applying to the Exceptional Case Funding scheme.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/1516", "label" : {"_value" : "Biography information for Andy Slaughter"} } , "tablingMemberConstituency" : {"_value" : "Hammersmith"} , "tablingMemberPrinted" : [{"_value" : "Mr Andy Slaughter"} ], "uin" : "223066"} , {"_about" : "http://data.parliament.uk/resources/177567", "AnsweringBody" : [{"_value" : "Ministry of Justice"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/177567/answer", "answerText" : {"_value" : "

Parliament agreed an exceptional case funding scheme to provide an avenue for providing legal aid to those cases that would normally be out of scope, in order to ensure we meet our obligations under the European Convention on Human Rights and European Union law.

Following the reforms to civil legal aid, funding remains available in around 95% of cases where a child or young person is the applicant. This includes legal aid for all public law children cases, and where a child is a party in private family law cases.

The Government has made clear that it will undertake a post-implementation review of the legal aid provisions within the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO) within 3-5 years of implementation. Although the scope of this review has not been finalised, it is expected that it will consider evidence from a wide range of sources.

This Government takes recovery and enforcement of financial impositions very seriously and remains committed to finding new ways to ensure impositions are paid and to trace those who do not pay. This is why there has been a year on year increase in the total amount of financial penalties collected over the last three years. The amount of money collected reached an all time high of £290 million at the end of 2013/14 and collections continue to rise. In 2013/14 the total outstanding balance of financial impositions reduced by £26.7m (5%) in the year.

In July 2014 HM Courts and Tribunals Service (HMCTS) started a pilot to utilise data provided by HM Revenue and Customs (HMRC) to enforce outstanding financial impositions. While the pilot is limited to a number of specifically targeted cases, early indications are that HMRC are able to provide data that assists in the enforcement of outstanding accounts.

So far HMCTS has sent over 124,000 accounts to HMRC who have been able to supply HMCTS with employer’s details on 40% of those accounts and self employment details on a further 22%. In addition, HMRC has been able to provide additional information, such as addresses and phone numbers, that differ from those held on the HMCTS account.

As a result HMCTS have secured attachment of earnings orders on 66% of the accounts where HMRC have been able to supply employer’s details. Additionally, HMRC data secured on some of the accounts in the remaining 34% has enabled us to take immediate alternative enforcement action, such as the service of a further steps notice, but may also enable future enforcement by attachment of earnings should it be required.

It is not possible to identify how much has been collected as direct result of the data received from HMRC, without checking every account in scope and establishing how many of those accounts would have been paid in full in any event. However, it is possible to confirm that use of the HMRC data has resulted in accounts that have been outstanding for a number of years suddenly being paid in full as a result of the attachment of earnings order, despite many previous attempts to enforce them.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/1528", "label" : {"_value" : "Biography information for Sir Mike Penning"} } , "answeringMemberConstituency" : {"_value" : "Hemel Hempstead"} , "answeringMemberPrinted" : {"_value" : "Mike Penning"} , "dateOfAnswer" : {"_value" : "2015-01-21", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2015-01-21T15:54:41.817Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2015-01-16", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Courts: Fines"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Justice, what assessment he has made of the effect of staff of his Department having access to HM Revenue and Customs information on individuals who have defaulted and are in employment on the level of collection rates of fines and compensation set by the courts.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/1516", "label" : {"_value" : "Biography information for Andy Slaughter"} } , "tablingMemberConstituency" : {"_value" : "Hammersmith"} , "tablingMemberPrinted" : [{"_value" : "Mr Andy Slaughter"} ], "uin" : "221135"} ], "itemsPerPage" : 10, "next" : "http://eldaddp.azurewebsites.net/answeredquestions.text?answeringDeptShortName=Justice&_page=1&tablingMemberConstituency=Hammersmith&max-date=2015-02-03", "page" : 0, "startIndex" : 1, "totalResults" : 160, "type" : ["http://purl.org/linked-data/api/vocab#ListEndpoint", "http://purl.org/linked-data/api/vocab#Page"]} }
