In accordance with the principle of open justice, the general rule is that all court proceedings must be held in open court to which the public and the media have access. There are, however, circumstances in which there may be restrictions on what can be reported. The statutory criteria for reporting restrictions in all criminal cases, including economic crime, can be automatic or discretionary.<\/p>
Automatic restrictions are only applied in limited situations or to specific points in the journey of a case, for example in pre-trial hearings to prevent reporting of decisions on admissibility of evidence. If discretionary restrictions are applied, the court must first be satisfied that failure to apply these restrictions would render the administration of justice impractical.
