The Crown Prosecution Service (CPS) collects finalised prosecutions data showing the sex of defendants for cases flagged as involving domestic abuse. Some, more limited, information is also available showing the identified relationship between defendant and complainant and whether the relationship is between people of the same or different sex.<\/p>

The table below shows the number of defendants prosecuted for domestic abuse where a relationship was identified as same sex (partner, ex-partner, spouse/civil partner or former spouse/civil partner), during each of the last ten years. The Crown Prosecution Service (CPS) collects finalised prosecutions data showing the sex of defendants for cases flagged as involving domestic abuse. Some, more limited, information is also available showing the identified relationship between defendant and complainant and whether the relationship is between people of the same or different sex.<\/p>

The main criminal offence under the Coronavirus Act relates to potentially infectious persons who refuse to co-operate with the police or public health officers, when they are required to be screened for COVID-19.<\/p>

There have been no successful prosecutions of any offence created by the Coronavirus Act 2020. A review of completed prosecutions to the end of August 2020 show that 141 cases were incorrectly charged under the Act; because there was no evidence they applied to potentially infectious people, which is what this law covers.<\/p>

However, data on prosecutions under the Health Protection (Coronavirus) Regulations 2020 shows that under the Regulations there have been 227 prosecutions resulting in guilty pleas, and 6 prosecutions found guilty after trial to the end of August. The Crown Prosecution Service (CPS) maintains a central record of the outcomes of completed prosecutions, as a count of the number of defendants finalised, and collates the data collected by quarter. Each non-conviction (or \u2018unsuccessful\u2019) outcome is allocated a reason, indicating the principal reason the defendant was not convicted.<\/p>

Over the last financial year 2019-20 the charging rate increased by over 10% and there was a 6.2% rise in the volume of rape cases proceeding to prosecution following a decision to charge. Although this is a promising trend which the CPS is seeking to maintain, there is clearly more to be done.<\/p>

The reasons behind the recent declines in prosecutions are complex and a whole system approach is necessary to address them. There is ongoing work to improve the handling of these sensitive cases and narrow the disparity between offences reported and cases going to court.<\/p>

In July the CPS published its own rape strategy, the first of its kind for any department. There is also an ongoing cross-Government review of the criminal justice response to rape. This is examining evidence across the system about the causes of the falls in outcomes for rape and identifying solutions to reverse the trend. In 2018 \u2013 29 sentences for causing death by dangerous driving were referred to the Attorney General\u2019s Office. Of those 4 were referred to the Court of Appeal under the Unduly Lenient Sentence Scheme. 2 sentences were found to be unduly lenient and the sentences were increased. 2 were found NOT to be unduly lenient and the sentences remained the same.<\/p>

In 2019 \u2013 43 sentences for causing death by dangerous driving were referred to the Attorney General\u2019s Office. Of those 2 were referred to the Court of Appeal under the Unduly Lenient Sentence Scheme. Both sentences were found to be unduly lenient and the sentences were increased.<\/p>

Parliament is sovereign as a matter of domestic law and can pass legislation, even if such legislation is in breach of the UK\u2019s treaty obligations. From time to time tensions arise between our international obligations and domestic legislation. In 2012, The House of Lords Reform Bill 2012-13 was brought forward with the statement that the Deputy Prime Minister at the time was \u2018unable to make a statement of compatibility under section 19(1)(a) of the Human Rights Act 1998\u2019 which reflects the UK\u2019s obligations under the European Convention on Human Rights (this Bill was later withdrawn for other reasons). Whilst pre-dating 2010, a further example from 2002 was when the then Government introduced the Communications Bill with a section 19(1)(b) certificate under the Human Rights Act 1998 (ie that whilst the Minster is unable to make a statement of compatibility the government nevertheless wishes to proceed with the Bill) because it was perceived that clause 309 of that Bill could be considered to violate our international obligations under article 10 of the ECHR.
