In order to protect access to justice, a system of fee waivers is available to those unable to afford court fees. Eligibility is based on an individual\u2019s ability to pay, and the scheme is targeted towards those in households on low incomes who are in receipt of certain state benefits. The Ministry of Justice has no plans to review the powers of the Court of Protection.
However, the department is currently changing the Court of Protection Rules. This will give the Court more flexibility to help it manage its caseload more efficiently.
The department and judiciary have been clear that there needs to be more openness in the Court of Protection, which deals with some of the most vulnerable people in society. The President of the Family Division's guidelines mean that more judgements are published than ever before.
The President and I will continue to push for ever greater transparency, where it is appropriate.<\/p>"}
