Recognising the Probation Service\u2019s crucial role in protecting the public and rehabilitation, the Department has committed to funding at least 1,000 additional trainee probation officers by the end of March 2025.<\/p>

Given the multitude of factors involved, each with its own budget, it is not feasible to isolate a single expense figure for SDS40 borne by the Probation Service. Commercial discussions are ongoing to confirm the level of additional expenditure the electronic monitoring service provider may charge.<\/p>

Throughout the SDS40 implementation process, HMPPS and partnered agencies have ensured robust support is in place for offenders leaving custody, including continuity of health and substance misuse provision and access to employment, benefits, and accommodation. The Government recently published the first official statistics to estimate the number of children affected by parental imprisonment using administrative government data. It's estimated that between 1 October 2021 and 1 October 2022 there were around 193,000 children with a parent in prison. We fully recognise the importance of being able to identify children with a parent in prison to make sure they receive the support they need to flourish and thrive, which is why a commitment on this was included in our manifesto.<\/p>

The Ministry of Justice is working closely with the Department for Education to determine how to effectively identify these children and provide support for both them and for the parent in prison. The Government was forced to introduce SDS40 to avoid the collapse of the criminal justice system. At the point when SDS40 came into effect on 10 September, the use of End of Custody Supervised Licence came to an end. In designing the SDS40 measure, we took every possible step to communicate with victims about the change and the impact it could have. We also put in measures to mitigate risk including an 8-week implementation period, clear offence exclusions, and a huge amount of collaboration with partners across the Criminal Justice System.<\/p>

The Government is aware of increasing localised pressure on burial spaces in certain parts of the country and we welcome information from burial providers and local communities about the situation in their areas, as this is helpful in enabling us to build an up-to-date national picture. Sentencing outcomes at court for offenders prosecuted for the offence of causing death by dangerous driving and other offences can be obtained through published data: Outcomes by Offence data tool: December 2023<\/a>.<\/p>

Provisions in the Police, Crime, Sentencing and Courts Act 2022 increased the maximum penalty from 14 years\u2019 imprisonment to life for the offences of causing death by careless driving when under the influence of drink or drugs, and causing death by dangerous driving. These measures came into force on 28 June 2022 and apply to offences committed on or after that date.<\/p>

The Sentencing Council has reflected these changes in the sentencing guidelines and the starting point for cases falling into the highest level of seriousness is now 12 years\u2019 imprisonment, a significant increase from the previous 8 years\u2019 starting point. The sentence range for the most serious instances is now 8 to 18 years\u2019 imprisonment.<\/p>

Although the starting points and sentence ranges for this offence have increased, the courts still retain the discretion to sentence outside of this range and impose a life sentence where the seriousness of the offence is such that they consider it more appropriate.<\/p>

The Crown Court outstanding caseload remains one of the biggest challenges facing the Criminal Justice System. The caseload has risen in recent years as a result of the pandemic and an increase in cases coming before the criminal courts.<\/p>

To address this, we plan to sit 106,500 working days at the Crown Court this financial year and continue to keep 18 Nightingale courtrooms open for 2024/25. Alongside this, we consistently invest in the recruitment of c.1000 judges and tribunal members annually and are also considering further measures to speed up justice.<\/p>

HMCTS receives a specified level of funding each year to operate the courts and tribunals. This level of funding is agreed by the Lord Chancellor and Lady Chief Justice via the Concordat process. Sitting days are subsequently allocated to regions and local courts.<\/p>

In 2024/25, Maidstone Crown Court is scheduled to sit at its maximum capacity in line with the number of judges and courtrooms it has available.
