Leaving the EU with a deal remains the Government’s top priority. This has not changed. However, a responsible government must plan for every eventuality, including a no deal scenario.

As laid out in the policy paper ‘Immigration from 31 October 2019, if there is no deal’ published on the 28 January 2019, if the UK leaves the EU without a deal there will be a transition period, once free movement has ended and before the UK’s new skills-based immigration system begins on 1 January 2021.

Arrangements for EU, EEA and Swiss citizens arriving after free movement ends, coming to visit, work or study, for the duration of less than three months, will not look any different.

To stay longer than three months during the transition period, newly arrived EU citizens will need to apply for European Temporary Leave to Remain, which lasts for a further 36 months. Those who want to stay in the UK beyond the granted 36 months will need to apply and qualify under the new skills-based immigration system, which will start to come into effect, deal or no deal, from 2021.

The future system will focus on skills and not nationality, welcoming talented and hardworking individuals who will support the UK’s dynamic economy, en-abling business and employers to continue to compete on the world stage.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4048", "label" : {"_value" : "Biography information for Caroline Nokes"} } , "answeringMemberConstituency" : {"_value" : "Romsey and Southampton North"} , "answeringMemberPrinted" : {"_value" : "Caroline Nokes"} , "dateOfAnswer" : {"_value" : "2019-07-24", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-07-24T15:10:36.54Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2019-07-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Vacancies"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, what steps he is taking to reduce the potential effect of the UK leaving the EU without a deal on labour shortages.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4139", "label" : {"_value" : "Biography information for Ian Lavery"} } , "tablingMemberConstituency" : {"_value" : "Wansbeck"} , "tablingMemberPrinted" : [{"_value" : "Ian Lavery"} ], "uin" : "278505"} , {"_about" : "http://data.parliament.uk/resources/1139827", "AnsweringBody" : [{"_value" : "Home Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1139827/answer", "answerText" : {"_value" : "

According to the 2018/2019 report produced by the Combined Homelessness and Information Network (CHAIN), which is publicly available online and can be accessed by anyone, 32 people were seen sleeping rough in Havering across the course of that year. CHAIN is a multi-agency database recording information about rough sleepers and the wider street population in London.

The Rough Sleeping Support Service, which was first announced in August 2018 as part of the Government’s Rough Sleeping Strategy, was introduced to help non-UK nationals sleeping rough resolve their immigration cases and access the support that they need. It does not undertake any enforcement action. It has an administrative role, conducting status checks, identifying priority cases and ensuring that we can help those who require evidence of their immigration status or assistance in leaving the UK.

The Home Office may take action on a case-by-case basis where individuals have exhausted all other avenues and are unwilling to leave the UK voluntarily. This is in line with existing immigration law.

Removals of non-UK rough sleepers cannot be disaggregated in the published statistics on the removal of those without lawful status. It is also not possible to directly attribute removals to interaction with the RSSS because a range of factors will have affected how decisions were reached in these cases. A person’s removal from the UK is determined by their immigration
status and circumstances, including unwillingness to depart voluntarily, not by contact with the RSSS.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4048", "label" : {"_value" : "Biography information for Caroline Nokes"} } , "answeringMemberConstituency" : {"_value" : "Romsey and Southampton North"} , "answeringMemberPrinted" : {"_value" : "Caroline Nokes"} , "dateOfAnswer" : {"_value" : "2019-07-22", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-07-22T16:17:43.623Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2019-07-17", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Sleeping Rough: Havering"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, how many rough sleepers there are in Havering; and how many have been deported by his Department's Rough Sleeper Support Service in each of the last three years.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/1447", "label" : {"_value" : "Biography information for Andrew Rosindell"} } , "tablingMemberConstituency" : {"_value" : "Romford"} , "tablingMemberPrinted" : [{"_value" : "Andrew Rosindell"} ], "uin" : "278422"} , {"_about" : "http://data.parliament.uk/resources/1139830", "AnsweringBody" : [{"_value" : "Home Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1139830/answer", "answerText" : {"_value" : "
