Article 3 of the Withdrawal Agreement published on 26 November clearly states that Gibraltar is covered to the extent that Union Law applied to it before. Article 184, which records the UK and the EU\u2019s commitment to negotiate in good faith and conclude agreements envisaged by the Political Declaration on their future relationship within a certain time frame, imposes no obligations regarding the territorial scope of future agreements. Article 9(a)(b) of the draft Withdrawal Agreement provides a definition of \u2018frontier workers.\u2019 \u201cFrontier workers\u201d are persons who pursue an economic activity in accordance with the provisions set out in Article 45 or 49 TFEU (Treaty on the Functioning of the European Union) in one or more States in which they do not reside.<\/p>

Economic activity is activity provided for remuneration. For the purposes of Article 9, economic activity must be in accordance with the provisions set out in Articles 45 or 49 TFEU.<\/p>

To be exercising an economic activity as a worker in accordance with Article 45 TFEU a person must be a \u2018genuine and effective\u2019 worker and the work must not be on such a small scale so as to be \u2018purely marginal or ancillary\u2019<\/p>

Article 49 TFEU provides for the freedom of establishment. A person is established in a particular state if they are participating \u2018on a stable and continuous basis\u2019 in the economic life of that State. If a person is providing temporary services they will not fall within the definition in Article 9(a)(b).<\/p>

No Scottish Limited Partnerships (SLPs) have been fined since the People with Significant Control register came into force.<\/p>

I refer the hon. Member to the answer given to her on 2nd July 2018 to Question 157783. Compliance is Companies House\u2019s primary aim, rather than prosecution. It is taking action to ensure that all SLPs report their PSC information. Companies House is actively engaged with SLPs and their representatives to make them aware of their responsibilities, and in addition, it has issued reminder letters to all SLPs who have failed to file PSC information. Failure to comply with the requirement to report PSC information does not incur a civil penalty but it is an offence and may lead to a fine or imprisonment upon prosecution. Companies House is not a prosecuting body and will refer cases to a relevant prosecutor when all other avenues have been exhausted and an SLP has not complied with their obligations.<\/p>

In April the Government consulted on a package of reforms which would limit the misuse of limited partnerships, including in their Scottish form. The policy aims to strike the appropriate balance between support for claimants with children and fairness to taxpayers and families with children who support themselves solely through work.
