The Immigration Act 1971 (the Act) sets out offences for illegal entry, illegal working, and assisting unlawful immigration into the United Kingdom.<\/p>

The Crown Prosecution Service (CPS) holds management information showing the number of offences charged by way of section 24 (illegal entry/arrival), section 25 (assisting unlawful immigration to member State or the UK), section 25A (helping an asylum-seeker to enter the UK), and section 25B (assisting entry to the UK in breach of deportation or exclusion order) of the Act in which a prosecution commenced and reached a first hearing at a magistrates\u2019 court.<\/p>

The table attached shows the number of these offences from the start of January 2005 to the end of September 2015.<\/p>

The CPS does not hold data which shows the number of defendants charged with, prosecuted, and convicted for offences created by the Act. The figures in the table relate to the number of offences and not the number of individual defendants. An individual defendant may be charged with more than one offence against the same complainant. No data is held showing the final outcome or if the charged offence was the substantive charge at completion of prosecution.<\/p>

The starts and completions for accredited programmes delivered in custody between March 2010 and March 2023 for (i) offender behaviour, (ii) sex offender, (iii) substance misuse, (iv) domestic violence and (v) extremism programmes are provided in figures 3.1 and 3.2 in Prison Education and Accredited Programme Statistics 2022 to 2023 - GOV.UK (www.gov.uk)<\/a>. Data for 2023-2024 will be published in the Prison Education and Accredited Programmes Statistics report on 26 September 2024.<\/p>

<\/p>

In custody, the longer-term decrease in Accredited Programme starts and completions has been primarily driven by the change of programme ownership \u2013 and responsibility for running substance misuse accredited programmes - from HMPPS to NHS. As of 1 April 2011, local NHS partnerships assumed these responsibilities. The large decreases seen reflect the fact that more offenders are completing programmes run by the NHS, rather than HMPPS. There has also been a reinvestment from shorter, moderate intensity programmes in favour of longer, higher intensity programmes along with the introduction of some 1:1 programmes. This better reflects the identified demand across HMPPS prisons. The number of commissioned completions has therefore decreased although overall maintaining investment.<\/p>

The starts and completions for accredited programmes delivered in the community from 2009-10 to 2014-15 for (i) offender behaviour, (ii) sex offender, (iii) substance misuse, (iv) domestic violence and (v) extremism programmes are published in the Accredited Programmes Bulletin at Tables 1.3 and 1.4 https://www.gov.uk/government/statistics/accredited-programmes-bulletin-2014-to-2015.<\/a><\/p>

The information for April 2015-March 2023 is contained in the attached table. The information for starts can be found in table 1 and for completions in table 2.<\/p>

We keep offending behaviour programmes under continual review, to ensure that they are effective in reducing reoffending and protecting the public.<\/p>

We have also introduced a range of programmes designed specifically to address Sexual Offending, including one specifically tailored to non-contact internet offending.<\/p>

Information on the number of public sector prison staff who were subject to conduct & disciplinary action since 2014/15 is given in table 1 in the attached spreadsheet. Figures are presented by financial year up to 2022-23.<\/p>

While the vast majority of Prison Service staff are hardworking and honest, we take all and any allegations extremely seriously and is investigated and where appropriate, disciplinary action is taken. There is no place in His Majesty\u2019s Prison & Probation Service (HMPPS) for any form of unacceptable behaviour.<\/p>

<\/p>

The Tackling Unacceptable Behaviours Unit (TUBU) was established in August 2020 and this has been followed by an increase in reported cases. Its aim is to help improve the working environment by providing support, insight and expertise to staff who raise concerns. The services TUBU provides include a confidential helpline to support staff who are experiencing any form of unacceptable behaviour; a mediation service to resolve workplace conflict; and an investigation service.<\/p>

<\/p>

The investigation service enables managers to obtain advice and signposting, and gives access to qualified investigators where there is an allegation of bullying, harassment, discrimination or victimisation.<\/p>

<\/p>

These measures now mean staff are reporting unacceptable behaviour more often.<\/p>

We have interpreted waiting time to refer to the time between the date of first hearing at the magistrates\u2019 court to completion of the case at the Crown Court.<\/p>

<\/p>

The median number of days from first listing to completion at the Crown Court for a) drug dealing, b) GBH, c) domestic burglary, d) theft cases offences has been provided in the attached table. To note, Crown Court data is only available from 2014 onwards and domestic violence offences cannot be separately identified as they are not defined as such in legislation.<\/p>

<\/p>

While the Crown Court is still recovering from the impact of the pandemic and disruptive action from the Bar which reduced our ability to hear cases swiftly, the latest published statistics show, across all cases currently in the outstanding caseload, the median age for those cases was around 6 months.<\/p>

We are committed to ensuring the delivery of swift justice for all victims and have introduced a raft of measures to achieve that aim. This includes funding around 107,000 sitting days during the most recent financial year (FY23/24), recruiting up to 1,000 judges annually across all jurisdictions and investing in the continued use of 20 Nightingale courtrooms into this financial year (FY24/25) to allow the courts to work at full capacity.<\/p>
