Requests from exemptions against safety standards are considered on a case by case basis. Under proposed legislation for older passenger vessels, no new damage stability requirements are expected to be applied to older domestic passenger vessels which operate exclusively on non-tidal Category C Waters.<\/p>

On tidal Category C waters, owners will be able to apply for exemptions against any new damage stability requirements if they can produce a risk assessment which demonstrates that their area of operation is one of low operational risk. These will also be considered on a case by case basis.<\/p>

In accordance with the Cabinet Office guidance on consultation principles, the Maritime and Coastguard Agency (MCA) conducted two public consultations on the implementation of the review of standards for older passenger ships from 6 November 2018 to 29 January 2019 and 29 May 2019 to 10 July 2019, and received 75 and 52 responses respectively. The consultations were published on gov.uk and notified extensively to stakeholders.<\/p>

In addition, the MCA engaged widely with stakeholders through the Domestic Passenger Ship Steering Group, and held five workshops with industry on the proposals, three during 2016, another in 2018 and a further one in 2019.<\/p>

  3. The Merchant Shipping (Fire Protection: Small Ships) Regulations 1998 (as amended) (SI 1998 No. 1011) (exemption provision Regulation 47).<\/p><\/li><\/ol>

    While the equivalence provisions in those regulations are open-ended it is normal to review regulatory provisions from time to time to ensure they remain fit for purpose and where necessary make changes.     The Maritime and Coastguard Agency (MCA) has had ongoing dialogue with the Passenger Boat Association (PBA) throughout the development of the proposals for older passenger boats.<\/p>

    The PBA is a member of the MCA\u2019s stakeholder group for the sector, the Domestic Passenger Safety Steering Group (DPSSG), which meets annually. The MCA\u2019s plans for older passenger vessels have been discussed at the DPSSG on several occasions.<\/p>

    <\/p>

    Additionally, MCA policy officials have held dedicated stakeholder meetings on the proposals for older passenger boats, at all of which the PBA have been represented. Three of these meetings were in 2016, one in November 2018 and another in March 2019. The MCA also met with a representative of the PBA, and another organization, in a small informal meeting on 15 May 2019.<\/p>

    A draft of the impact assessment (IA) was published during a public consultation which ran from 6 November 2018 to 29 January 2019. Consultees were invited to comment on the validity of the analysis in the IA and encouraged to provide information that would help to strengthen this. A further consultation focussing on the policy and legislation was carried out between 29 May and 10 July 2019. No specific discussion took place between the Department and regional tourism bodies, but the consultation was open to comments from them. The IA was amended to take account of any relevant comments received.     I also responded to a letter of 30 April 2019 from the Mayor and a London Assembly Member who enquired about the Maritime and Coastguard Agency (MCA) proposals, providing contact details of officials in the MCA should they require further information.<\/p>

    The MCA consulted upon an impact assessment during a public consultation which ran from 6 November 2018 to 29 January 2019, and again on policy and legislation from 29 May to 10 July 2019. Consultees were invited to comment on the validity of the analysis in the impact assessment and encouraged to provide information that would help to strengthen this. The impact assessment has been updated to reflect the range of further information provided through consultee feedback.<\/p>
