Reports of Indecent Images of Children (IIOC) can be made to the Internet Watch Foundation (IWF) which is an industry funded body. In 2014 the IWF processed 74,119 reports, of which 31,443 were confirmed as depicting illegal content. The IWF can proactively search the Internet for IIOC and this has vastly increased the number of webpages being taken down.<\/p>

100% of UK-hosted webpages confirmed by the IWF as containing IIOC were removed within four days, although most were taken down within two hours. 84% of webpages hosted outside the UK, and confirmed by the IWF as containing IIOC, were removed within 10 days. This material has been removed permanently, rather than simply having access to it blocked. The IWF also provides a list of webpages containing IIOC, primarily hosted outside the UK, to enable companies to block or filter them for their customers\u2019 protection. The Child Abuse Image Database (CAID) was launched in December 2014 and supersedes the interim National Hash Set Database. All of the hashes relating to Indecent Images of Children from the interim National Hash Set Database managed by Cheshire Constabulary were added to CAID along with hash sets held by other UK law enforcement agencies.<\/p>

CAID contains over four million images. All these images appearing on CAID have an indicative categorisation based on police force grading or \u2018votes\u2019. Of these images, at present, fewer than 600,000 have been categorised as having a \u201ctrusted grade\u201d. This \u201ctrusted grade\u201d is achieved once the image has received three independent, undisputed votes by police forces encountering them. These are therefore the images which have been most reliably assessed as being Indecent Images of Children.<\/p>

Every referral of child sexual abuse reported to the National Crime Agency (NCA) is thoroughly assessed and developed. All cases where potential suspects are identified are disseminated to a UK police force, actioned by the NCA, or disseminated to a foreign jurisdiction via Interpol. It is for each of the recipients to assess the intelligence and potential for prosecution and to take executive action appropriately. Information on these investigations is not held centrally, except for NCA investigations. No investigations by the NCA into

Operation NOTARISE is an ongoing NCA-led, UK-wide operation which is identifying and taking law enforcement action against individuals viewing
indecent images of children. Activity in Operation NOTARISE was prioritised according to how much risk the individuals presented, including checking the appropriate databases.

Those with access to children have been given the highest priority. As of 23 October, 704 people have been arrested, 133 children protected and
324 children safeguarded. It would not be appropriate to share any furtherdetails of operational procedures.<\/p>

There are limits to what can be said publically about the operational techniques used by our law enforcement agencies. To do so would assist
potential criminals to evade detection. However, in investigations that start with an online identifier or IP address, such as online child sexual
exploitation cases, communications data will often be the only available investigative lead to identify a suspect or victim in the real world. If this
data is not available, such investigations cannot proceed. As the Director General of the National Crime Agency, Keith Bristow, has made clear:
"Communications data is still overwhelmingly the most powerful tool available to those investigating child sexual exploitation and identifying and
safeguarding its victims and potential victims."<\/p>

The Government takes the issue of indecent images of children very seriously, and is working with a wide range of international partners to tackle these appalling images. We work with both EU and non-EU States, and will continue to do so. As explained in the Government\u2019s answer of 2 September 2014 to PQ 207065, the Government has considered the potential impacts of CJEU jurisdiction very carefully in deciding which of the pre-Lisbon police and criminal justice measures it is in the interests of the UK to rejoin.<\/p>


While the CJEU has not yet ruled in a relevant case, Article 72 of the Treaty on the Functioning of the European Union (TFEU) makes clear that the maintenance of law and order and the safeguarding of internal security is a responsibility for Member States. In addition, Article 276 of the TFEU states that the CJEU shall have no jurisdiction to review the validity or proportionality of operations carried out by the police or other law enforcement services of a Member State, or the exercise of responsibilities incumbent upon Member States with regard to the maintenance of law and order and the safeguarding of internal security.<\/p>


The decision to seek to opt in to Council Decision 2000/375/JHA will therefore not bring the Government\u2019s strategy in tackling indecent images of children under the jurisdiction of the CJEU or any action taken by UK law enforcement pursuant to that strategy.<\/p>

The Government has considered the potential impacts of CJEU jurisdiction very carefully in deciding which of the pre-Lisbon police and criminal justice measures it is in the interests of the UK to rejoin. Article 72 of Treaty on the Functioning of the European Union (TFEU) makes clear that the maintenance of law and order and the safeguarding of internal security is a responsibility for Member States.<\/p>

Article 276 of the TFEU states that the CJEU shall have no jurisdiction to review the validity or proportionality of operations carried out by the police or other law enforcement services of a Member State, or the exercise of responsibilities incumbent upon Member States with regard to the maintenance of law and order and the safeguarding of internal security.<\/p>

The Government\u2019s decision to seek to opt in to Framework Decision 2000/375/JHA will therefore not bring the Government\u2019s strategy in tackling indecent images of children under the jurisdiction of the CJEU or any action taken by UK law enforcement pursuant to that strategy. The UK is fully compliant with this Council Decision, and we assess the risk of an adverse judgement in this area to be low.<\/p>
