I refer the hon. Member to the answer to Question 215614, from 6 February 2019.

Since the introduction of The Universal Credit (Transitional Provisions) (SDP Gateway) Amendment Regulations 2019, which came into force on 16th January 2019, claimants who are entitled, or have been within the last month, to an award of an existing benefit that includes SDP have not been required to move to Universal Credit; even if they have experienced a relevant change in their circumstances. The draft Universal Credit (Managed Migration Pilot and Miscellaneous Amendments) Regulations 2019, which are currently before Parliament, make provision for SDP transitional payments for those eligible claimants who have already moved to UC and for moving existing legacy claimants onto Universal Credit and implementing transitional protection.

We are currently considering the court judgment handed down on 3 May 2019.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4105", "label" : {"_value" : "Biography information for Justin Tomlinson"} } , "answeringMemberConstituency" : {"_value" : "North Swindon"} , "answeringMemberPrinted" : {"_value" : "Justin Tomlinson"} , "dateOfAnswer" : {"_value" : "2019-05-08", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-05-08T13:44:40.18Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "29"} , "answeringDeptShortName" : {"_value" : "Work and Pensions"} , "answeringDeptSortName" : {"_value" : "Work and Pensions"} , "date" : {"_value" : "2019-05-01", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Universal Credit: Disability"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Work and Pensions, what estimate he has made of the number of people in receipt of severe disability premium (SDP) who claimed universal credit before 16 January 2019 and who will be repaid their entitlement to SDP when the Universal Credit (Managed Migration) Regulations 2018 come into force.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4662", "label" : {"_value" : "Biography information for Ruth George"} } , "tablingMemberConstituency" : {"_value" : "High Peak"} , "tablingMemberPrinted" : [{"_value" : "Ruth George"} ], "uin" : "249942"} , {"_about" : "http://data.parliament.uk/resources/1110629", "AnsweringBody" : [{"_value" : "Department for Work and Pensions"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1110629/answer", "answerText" : {"_value" : "
The Department is committed to ensuring that all claimants, especially the most vulnerable, are supported as they move and the aim of the pilot is to ensure claimants on all legacy benefits with a range of different characteristics can successfully move onto Universal Credit. All individuals involved in the pilot process will be tracked through the process and there will be safeguards in place to protect them throughout the journey.

We are working closely with a diverse range of stakeholders, including those who focus on disability and mental health, so that a range of insights are played into the design of the pilot and we will work with partners to ensure we reach everyone in the most effective and supportive way, and that no-one is left behind. Learnings from the pilot will shape the future support we provide to claimants.

The Department has committed to reporting its findings from the pilot to Parliament before we continue.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4105", "label" : {"_value" : "Biography information for Justin Tomlinson"} } , "answeringMemberConstituency" : {"_value" : "North Swindon"} , "answeringMemberPrinted" : {"_value" : "Justin Tomlinson"} , "dateOfAnswer" : {"_value" : "2019-04-15", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-04-15T10:37:06.117Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "29"} , "answeringDeptShortName" : {"_value" : "Work and Pensions"} , "answeringDeptSortName" : {"_value" : "Work and Pensions"} , "date" : {"_value" : "2019-04-09", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Universal Credit"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Work and Pensions, whether her Department will report to Parliament on its evaluation of the effect of the managed migration pilot on (a) disabled people, (b) people with mental health conditions and (c) people identified by her Department as having complex needs.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4662", "label" : {"_value" : "Biography information for Ruth George"} } , "tablingMemberConstituency" : {"_value" : "High Peak"} , "tablingMemberPrinted" : [{"_value" : "Ruth George"} ], "uin" : "242940"} , {"_about" : "http://data.parliament.uk/resources/1088745", "AnsweringBody" : [{"_value" : "Department for Work and Pensions"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1088745/answer", "answerText" : {"_value" : "
An appeal can only be made against a decision which has gone through the Mandatory Reconsideration (MR) process. In law it is not possible to revise a tribunal decision.
