In 2017, the Law Commission\u202fpublished\u202fa\u202freport\u202fof\u202ftheir\u202freview of\u202fevent\u202ffees on behalf of\u202fthis Department.\u202fThis followed\u202fconcerns\u202fraised\u202fby\u202fthe Competition and Markets Authority\u202fabout\u202fthe fairness of some retirement property leases that have resulted in leaseholders paying an\u202fevent\u202ffee of between 0.25% and 30% of the sale price of the property when selling or sub-letting. Concerns were also raised about the lack of transparency of\u202fevent\u202ffees for older people and their families when purchasing a leasehold retirement property.\u202fThe Law Commission made\u202fa number of\u202frecommendations\u202fin its\u202freport, which\u202fcan be downloaded at\u202fhttp://www.lawcom.gov.uk/project/event-fees-in-retirement-properties<\/a>.<\/p>

The Government responded to the Law Commission, thanking them for the report\u202fand agreeing to\u202fimplement\u202fthe majority of\u202fthe\u202frecommendations.<\/p>

This includes a\u202fnew statutory code of practice which will ensure that these fees cannot be charged unexpectedly, while fees that breach it will be regarded as unenforceable and developers and estate agents will be required to make all such fees crystal clear to people before they buy, so prospective buyers can make an informed decision before\u202fforming a financial or emotional attachment to a property.<\/p>

To ensure safe and high-quality buildings, it is important that anyone involved in a project throughout a building's lifecycle is competent to do their job properly and in compliance with the Building Regulations. The Government is working with industry to develop the professional standards of competence of those working across the built environment and enforcing a stringent new regulatory regime for high-rise residential and other in scope buildings for the Building Safety Regulator.<\/p>

The Party Wall Act provides a framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations near buildings. The Act is separate from obtaining planning permission or building regulations approval. At present, there are no plans to amend the Act.<\/p>

It is important that local authorities plan well for the infrastructure required to support housing development, taking into account Government funding streams such as the Road Investment Strategy and securing appropriate contributions from developers. Developer contributions can be secured through section 106 planning obligations or the Community Infrastructure Levy. The 'Planning for the Future' White Paper' proposes a new 'Infrastructure Levy' to replace the existing system. The consultation on 'Planning for the Future' closed on 29 October 2020 and we will be responding formally.<\/p>

The Government published its second Road Investment Strategy in October 2019, which allocated grant funding of £27.4 billion from 2020-2025. Other funding streams include NHS England, the Environment Agency, and various schools funding programmes. The National Planning Policy Framework is clear that local planning authorities should identify and update annually a supply of specific deliverable sites sufficient to provide a minimum of five years' worth of housing against their housing requirement set out in adopted strategic policies.<\/p>

The Government wants to see homes built faster and expects house builders to build out as soon as possible once planning permission is granted.<\/p>

Where build-out is delayed, it is for councils and developers to work closely together to overcome any barriers. To support them, this Government is looking at strengthening the tools available to local authorities to encourage faster build out rates. Under mandatory HMO licensing, all local authorities must license HMOs in which five or more people from two or more households share facilities.<\/p>

Local authorities are responsible for drawing up and operating their allocation scheme for social housing within the framework of legislation which ensures that they must give 'reasonable preference' to specific groups including people who need to move on medical or welfare grounds, including grounds relating to a disability. This will include people with mental health problems.<\/p>

Statutory guidance in 2012 advises local authorities to consider giving additional preference to those who those who need to move urgently because of a sudden disability.<\/p>

The Social Housing White Paper sets out clear expectations that all social housing tenants, especially those with mental health problems, receive a professional service from competent and empathetic landlord staff.
