The Crown Prosecution Service (CPS) does not hold any data which shows the number of suspects charged with the offence of rape. However, management information is held showing the number of suspects charged, by sex, flagged as involving allegations of rape where the CPS authorised a charge and a prosecution has commenced in each of the last three years ending March 2022. The Crown Prosecution Service (\u2018CPS\u2019) collects data showing the outcome of charging decisions, including cases flagged as rape where a decision not to prosecute was taken for public interest reasons. However, the CPS has no central record of the number of cases or suspects where a confession to the offence of rape (or any other offence) has been admitted. This information could only be obtained by an examination of CPS case files, which would incur disproportionate cost.<\/p>

The table below therefore shows the number of rape-flagged suspects where a no prosecution decision for public interest reasons was the outcome. The proportion of decisions where no further action is taken due to public interest reasons is fewer than 2% of all decisions. However, data on cases in which a confession has been admitted is not available.<\/p>

Over the last financial year 2019-20 the charging rate increased by over 10% and there was a 6.2% rise in the volume of rape cases proceeding to prosecution following a decision to charge. Although this is a promising trend which the CPS is seeking to maintain, there is clearly more to be done.<\/p>

The reasons behind the recent declines in prosecutions are complex and a whole system approach is necessary to address them. There is ongoing work to improve the handling of these sensitive cases and narrow the disparity between offences reported and cases going to court.<\/p>

In July the CPS published its own rape strategy, the first of its kind for any department. There is also an ongoing cross-Government review of the criminal justice response to rape. This is examining evidence across the system about the causes of the falls in outcomes for rape and identifying solutions to reverse the trend. Work on the joint inspection by HM Crown Prosecution Service Inspectorate and HM Inspectorate of Constabulary and Fire & Rescue Services (led by the latter) has been delayed by COVID-19. However, a draft framework and methodology have been shared with stakeholders, including the Victims Commissioner, for consultation and an external reference group has been formed with the first virtual meeting to take place on 10th<\/sup> August 2020.<\/p>

The
additional £85 million for the Crown Prosecution Service (CPS) will be spent
over two financial years; £5 million in 2019-20 and £80 million in 2020-21. This
investment will enable the CPS to respond effectively to the expected increase
in caseload resulting from the recruitment of 20,000 new police officers; to
better meet their disclosure obligations; to work with investigators to pursue
all reasonable lines of inquiry; and to deliver much needed changes to external
counsel fees. Investing in the CPS to meet these pressures is essential for
justice to be served.<\/p>

additional resources for disclosure will support the development of stronger
