Employment and Support Allowance (ESA) the \u201cnew style\u201d benefit is solely based on the claimant\u2019s national insurance (NI) contributions. The income-related strands of the benefit have been removed. This means that New Style ESA (NS ESA) can be paid alongside Universal Credit (UC), where appropriate.<\/p>

<\/p>

Claimants who don\u2019t qualify for UC, due to the level of their household income, might still qualify for NS ESA.<\/p>

<\/p>

If eligible for NS ESA, a claimant will be awarded a Class 1 NI credit for each complete benefit week that the benefit is in payment. A benefit week runs from Sunday to Saturday.<\/p>

<\/p>

Where there is no entitlement to NS ESA, a person may still be entitled to NI credits provided they continue to meet the eligibility conditions.<\/p>

Information about claiming NI credits is included in the decision letter sent to the claimant informing them that they are not entitled to ESA. Following the MH and RJ judgments, the Department updated its guidance on Personal Independence Payment (PIP). In June 2018 it began an administrative exercise to identify claimants assessed using previous guidance to identify those who may be entitled to more support under PIP.<\/p>

Claimants who have had a tribunal decision since the judgments are not being reviewed as part of the MH RJ administrative exercise. The tribunals are obliged to apply the law as it stands (including the MH and RJ Upper Tribunal judgments) to all appeals, and to award claimants accordingly. We are committed to continually improving the Personal Independence Payment service. As part of this, in November 2018, we started to pilot video recording of PIP assessments. The pilot is examining the potential benefits of video recording face-to-face assessments. We will be evaluating this pilot and will use the findings to inform our approach to video recording in the future.<\/p>
