In May we published the Online Safety Bill<\/a> in draft. This is a major milestone in the development of a new regulatory framework to keep users safe online. For the first time, tech companies are going to be accountable to an independent regulator to keep their users safe. The draft bill will be subject to pre-legislative scrutiny in this session, with the Joint Committee due to report by 10 December.<\/p>


<\/strong>We are also taking steps to educate and empower users to make more informed and safer choices online. In July we published the first government
Online Media Literacy Strategy<\/a>, which sets out the government\u2019s approach to improving media literacy capabilities among internet users in England. Ahead of Online Safety legislation, the government is taking robust action to ensure that children and vulnerable users are safe online.<\/p>

<\/strong><\/p>

Our new regulatory regime for UK-established video sharing platforms requires them to take appropriate measures to protect under-18s from harmful material. Ofcom will be able to take enforcement action against platforms that do not comply.<\/p>

The Age Appropriate Design Code, which will come into force in September 2021, will provide stronger protections for children\u2019s personal data and guidance to companies on the privacy standards they must adopt on services that children are likely to access and which process their personal data.<\/p>

On 14th July we published the government\u2019s Media Literacy Strategy, which will educate and empower users with the skills and knowledge they need to keep themselves safe online, with an amplified focus on vulnerable and disabled users.<\/p>

In June 2021, we published Safety by Design guidance and a One Stop Shop on child online safety. This guidance will ensure that companies are equipped with the knowledge that they need to embed safety into platform design to protect users.<\/p>

The voluntary, non-statutory guidance entitled \u2018Online Safety Guidance if you own or manage an online platform\u2019 published by the Government is targeted at small and medium-sized enterprises (SMEs) and at start-up organisations, specifically those that are likely to be in scope of future Online Safety legislation. The guidance was developed in consultation with relevant SMEs and start-ups to understand their needs and to frame the guidance in the most user-friendly and effective way. This included multiple rounds of user research and feedback on how information should be presented.<\/p>

We are unable to publicly name individual companies that took part in user testing, due to the approach agreed with these organisations when they took part in the research. DCMS also worked with relevant industry bodies who represent hundreds of SME and start-up organisations to draw up the content for the guidance. This includes Tech Nation, the Coalition for a Digital Economy (Coadec), the Federation of Small Businesses, the Independent Game Developers' Association (Tiga) and the Association for UK Interactive Entertainment (UKIE), as well as subject matter experts in government and civil society.<\/p>

The Online Safety Bill was developed jointly by DCMS and the Home Office, involving close cooperation at Ministerial and official level.<\/p>

<\/strong><\/p>

The government is deeply concerned about the growth and scale of online fraud. The Online Safety Bill, published on the 12th May, will therefore require companies in scope of regulation to take action to tackle fraud, where it is facilitated through user-generated content (for example by social media posts) or via search results. We expect the regulatory framework to have a particular impact on specific types of fraud, such as romance scams, which are estimated to cost over £60 million a year and cause significant psychological harm to victims.<\/p>

The Online Safety Bill will be subject to pre-legislative scrutiny in this session. It is for Parliament to determine when the Bill will be scrutinised but I hope that the process will be able to start shortly now that the draft Bill has been published. This is a priority for my Department and for the Home Office, however the timetable for introduction is dependent on the wider parliamentary timetable.<\/p>

<\/strong><\/p>

The Online Safety Bill will place a duty on Ofcom to carry out a risk assessment of the sector and, as soon as is reasonably practicable, to issue guidance to companies about risk assessments. Companies will then have three months to carry out their risk assessments, unless they agree a longer timetable with Ofcom.<\/p>

<\/strong><\/p>

In order to assess the effectiveness of the regulatory framework, the Online Safety Bill provides for a review to be undertaken by the Secretary of State, to be published and laid before Parliament, between 2 and 5 years after the duties on services are commenced.<\/p>

Companies will need to assess whether these harms are likely to appear on their services and mitigate the risks of them doing so. Ofcom will set out details on how this can be achieved in codes of practice. Where appropriate, these will include measures to address cross-platform harms and could include cooperation between platforms.<\/p>

Ofcom will also undertake research and horizon-scanning to spot any cross-platform emerging issues, backed up by robust information gathering powers. The Online Safety Bill seeks to empower all users, including vulnerable users, to keep themselves safe online and to enjoy their right to freedom of expression. It aims to ensure everyone can participate online, without risk of bullying or being attacked on the basis of their identity.<\/p>

The Bill\u2019s Impact Assessment does not directly address the indirect benefits of encouraging wider participation as a result of reducing harm encountered online. However, the impact on online participation is being considered by the Department, as part of wider work on the impact of the policy and through the continued development of the evidence base around online harms.<\/p>

The forthcoming Media Literacy Strategy will also consider how media literacy, education and empowerment can support all users to participate in online life.<\/p>
