The Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018 were developed to help improve welfare standards across a range of activities involving animals that are licensed by local authorities.<\/p>
<\/p>
We are committed to learning from implementation and to make improvements where necessary and evidenced. There is a statutory requirement to complete a Post Implementation Review of the legislation by October 2023. We will consider the effectiveness of the associated guidance including the star rating system alongside this work.<\/p>
<\/p>
As part of planning for this review, we are proactively working with partners, including local authorities, to collate data that can provide a picture of licensed and unlicensed activities involving animals in England. This Government has gone further than educating the public on the issue of dog conformation and has restricted licensed breeding activities which might lead to such outcomes through the Animal Welfare (Licensing of Activities) (England) Regulations 2018. Under the 2018 Regulations licensed breeders are prohibited from keeping dogs for breeding if it can be reasonably expected that on the basis of their genotype, phenotype or health, this would lead to welfare problems for the mother or the puppies.<\/p>
<\/p>
Under the 2018 Regulations local authorities have powers to grant, refuse or revoke a licence. Licencees must achieve and maintain statutory minimum animal welfare standards, linked to the welfare needs of the Animal Welfare Act 2006. Anyone who carries on a licensable activity without a licence is liable to imprisonment, a fine or both.<\/p>
<\/p>
More broadly, provisions included in the Animal Welfare Act 2006 require owners or handlers of animals to protect them from harm and to provide for their welfare needs in line with good practice, and a breach of these provisions may lead to imprisonment a fine, or both. The 2006 Act is backed up by the statutory Code of Practice for the Welfare of Dogs which provides owners and keepers with general welfare information, including a specific section on how to protect them from pain, suffering, injury and disease: https://www.gov.uk/government/publications/code-of-practice-for-the-welfare-of-dogs<\/a>.<\/p> <\/p> That section of the Code of Practice recommends owners thinking of breeding from their dogs consult their vets, who can provide information on the risks of inherited conditions and exaggerated features that could affect the welfare of the puppies. The Code of Practice also reminds owners of their responsibility to care for the dog throughout its pregnancy.<\/p> <\/p> In addition, my department maintains Petfished, a public communications campaign, to raise awareness of issues associated with the low-welfare and illegal supply of pets. This includes guidance on ensuring that a dog's physical appearance has minimal adverse impact on their physical well-being and welfare.<\/p>"}

Significant steps have already been taken to improve and update the laws on dog breeding in England to crack down on unscrupulous breeders who breed dogs purely for financial greed at the expense of animal welfare.<\/p> Where the commercial breeding of dogs is concerned, animals are protected by the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018 (the 2018 Regulations). Under the 2018 Regulations no dog may be kept for breeding if it can reasonably be expected, on the basis of its genotype, phenotype or state of health that breeding from it could have a detrimental effect on its health or welfare or the health or welfare of its offspring, and would include suffering from Brachycephalic Obstructive Airway Syndrome.<\/p> In addition, my department maintains Petfished, a public communications campaign, to raise awareness of issues associated with the low-welfare and illegal supply of pets. This includes guidance on ensuring that a dog's physical appearance has minimal adverse impact their physical well-being and welfare.<\/p> More broadly, where an animal is subject to inappropriate breeding practices, whether for commercial activity or not, their welfare may suffer. To combat this all animals are protected under the Animal Welfare Act 2006. The 2006 Act requires those in charge of animals to protect them from harm and to ensure they have five key welfare needs provided for. Those in charge of animals who fail to protect them from harm, or fail to provide for their welfare needs may be prosecuted and face penalties including a custodial sentence or an unlimited fine, or both.<\/p> <\/strong><\/p>"}

This was followed by a joint workshop with the Institute of Acoustics (IOA). Members of the scoping panel ran a dedicated session at the annual IOA conference in October 2020 and outputs were reported in an IOA Acoustics publication.<\/p> <\/p> Defra is a member of both the BSi Committee for Transportation Noise and the scoping panel and continues to work collaboratively with other members as the Standard moves towards drafting stage.<\/p>"}
