The Department recently launched a consultation on proposals to update the Department’s statutory safeguarding guidance, Keeping Children Safe in Education, from September 2018. The consultation closes on 22 February 2018.

As part of the consultation, the Department is seeking views regarding information that schools hold in relation to the number of contacts and if going beyond the legal minimum is the sensible approach to take.

The Department plans to publish the revised Keeping Children Safe in Education guidance, for information, early in the summer term 2018. This should give schools and colleges sufficient time to review their policies and procedures and make any changes necessary to meet the requirements before the guidance comes into force in September 2018.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/111", "label" : {"_value" : "Biography information for Nick Gibb"} } , "answeringMemberConstituency" : {"_value" : "Bognor Regis and Littlehampton"} , "answeringMemberPrinted" : {"_value" : "Nick Gibb"} , "dateOfAnswer" : {"_value" : "2018-02-09", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2018-02-09T13:30:12.38Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "60"} , "answeringDeptShortName" : {"_value" : "Education"} , "answeringDeptSortName" : {"_value" : "Education"} , "date" : {"_value" : "2018-02-01", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Truancy"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Education, if his Department will require schools in England to make telephone calls to second and third named contacts to follow up on the unauthorised absence of children from school.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/473", "label" : {"_value" : "Biography information for Sir Mark Hendrick"} } , "tablingMemberConstituency" : {"_value" : "Preston"} , "tablingMemberPrinted" : [{"_value" : "Sir Mark Hendrick"} ], "uin" : "126074"} , {"_about" : "http://data.parliament.uk/resources/834673", "AnsweringBody" : [{"_value" : "Department for Education"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/834673/answer", "answerText" : {"_value" : "

Local authorities have a duty to plan and secure sufficient schools for their area. Where a local authority identifies the need to establish a new school, Section 6A of Education and Inspections Act 2006 places the local authority under a duty to seek proposals to establish an academy (free school) and to specify a date by which proposals must be submitted to the local authority. This is known as the free school presumption and is the main route for local authorities to set up new schools. The Local authority must also provide the site for the school.

All schools have the autonomy to decide the structure and duration of their school day, which includes the flexibility to decide when their school day should start and finish. The Department does not collect data on the number of schools who have chosen to make changes to their school days. We trust head teachers to decide how best to structure their school day to support their pupils’ education.

The Education (School Day and School Year) (England) Regulations 1999 require all maintained schools to be open to educate their pupils for at least 380 sessions (190 days) in each school year. There are no specific legal requirements setting out over how many days in each week these sessions should be delivered, or how long each individual school day should be. Governing bodies of all maintained schools in England are responsible for deciding when sessions should begin and end on each school day. They are also responsible for deciding the length of each lesson and the timings for the morning session, the midday break, and the afternoon session. Academy and free school funding agreements state that the duration of the school day is the responsibility of the academy trust.
