The Homes (Fitness for Human Habitation) Act 2018 is helping to drive up standards in the private and social rented sectors by putting an obligation on landlords to ensure that any rented residential properties are free of all hazards, including overcrowding, from which a risk of harm may arise to the health or safety of the tenant or another occupier of the property. This requirement applies from the outset and for the duration of the tenancy.<\/p>
This Department has not made a specific assessment of the implications for properties that are smaller than 13 square metres in relation to the Homes Act. The courts will decide whether a property is fit for human habitation by considering the matters set out in section 10 of the Landlord and Tenant Act 1985, which includes the \u2018overcrowding\u2019 hazard prescribed in the Housing Health and Safety (England) Regulations 2005. Each property is assessed on its own merits, and if a property is so small as to be hazardously overcrowded, tenants will have the right to take action in the courts for breach of contract on the grounds that the property is unfit for human habitation.<\/p>
Government is also reviewing the hazards set out in the 2005 Regulations as part of the comprehensive review of the Housing Health and Safety Rating System (HHSRS).<\/p>

The Department does not hold this data but the Government takes the view that all forms of hate crime are completely unacceptable. In October 2018 the Government refreshed the Hate Crime Action Plan, and committed additional funding to continue to protect places of worship - since 2016 Government\u2019s Places of Worship scheme has approved 17 grants to Gurdwaras. Additionally, we have committed just over £1.5 million for projects to tackle all forms of racially and religiously motivated hatred. The Government has an extensive engagement programme with all faith communities, including the Sikh community through the MHCLG-led Sikh roundtable. The Department does not hold centrally the availability of refuges for victims of domestic violence in St Helens borough and the North West.<\/p>
We are currently consulting on the Future Delivery of Support to Victims and their Children in Accommodation-Based Domestic Abuse Services closing on 2 August. The proposals for a statutory duty will require local authorities to convene a Local Partnership Board. Local Partnership Boards will be responsible for robustly assessing need for support for victims and their children in safe accommodation, developing, agreeing and publishing an area-wide Domestic Abuse Strategy, ensuring local commissioning of support services is in line with this to meet the diverse support needs of victims and their children and report to central Government on progress.<\/p>

The most recent data for families with children in temporary accommodation was published in May 2019 and can be found here: https://www.gov.uk/government/statistical-data-sets/live-tables-on-homelessness<\/a><\/p> Time spent in temporary accommodation can mean people are getting help and it ensures no family is without a roof over their head.<\/p> The Homelessness (Suitability of Accommodation) (England) Order 2012 helps prevent the use of temporary accommodation long distances from the family\u2019s previous home and community. Homeless households also have legal rights to request a review of a decision to place them in unsuitable accommodation.<\/p> In 2011, the law was changed to allow councils to place homeless families in decent and affordable private rented homes as well as social rented homes. This now means homeless households should not have to wait as long for settled accommodation.<\/p> The Government has targeted funding streams focused on reducing the number of households in Temporary Accommodation. For example we have recently launched the Private Rented Sector (PRS) Access Fund which will fund schemes that will support families who are or at risk of homelessness, supporting them to sustain and access PRS accommodation.<\/p> <\/p> <\/p> <\/p> <\/p>"}

The Department does collect information on overcrowding and on concealed households (usually defined as single adults or groups of adults, with or without children, who occupy the accommodation with, but do not belong to, the household reference person\u2019s family unit) through the English Housing Survey. Additional information is being collected through this survey to identify people who have experienced homelessness.
The Homelessness Reduction Act brings more people such as single homeless households into scope to receive assistance from their local authority. These households were not assisted or reported through the old P1E collection, until the end of March 2018. Details on these non-priority need, single households often living with friends and family have been captured through the Department\u2019s new case level data collection system, Homelessness Case Level Information Collection (H-CLIC), since April 2018. The new data collection system, H-CLIC, captures information on households approaching for and receiving homelessness assistance, household demographics and the circumstances surrounding their homelessness. This includes any support needs of the homeless household. In time it will enable MHCLG to monitor repeat homelessness where people come back to services. It will help identify more detail on the circumstances of households vulnerable to homelessness and the interventions that are successful in preventing homelessness in the first place.<\/p>"}
