During this period there has been a shift in the type of pre-charge decisions referred to the CPS. For example, in the period between 2013/14 and 2017/18, there was an increase of over 26% in rape flagged pre-charge decisions referred to CPS West Midlands. Rape and serious sexual offences investigations can be highly complex in nature and typically involve the review of a large quantity of evidence resulting in an increase in the amount of time required for the CPS to come to a charging decision.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4517", "label" : {"_value" : "Biography information for Lucy Frazer"} } , "answeringMemberConstituency" : {"_value" : "South East Cambridgeshire"} , "answeringMemberPrinted" : {"_value" : "Lucy Frazer"} , "dateOfAnswer" : {"_value" : "2019-05-20", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-05-20T10:24:38.683Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "88"} , "answeringDeptShortName" : {"_value" : "Attorney General"} , "answeringDeptSortName" : {"_value" : "Attorney General"} , "date" : {"_value" : "2019-05-14", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Prosecutions: West Midlands"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Attorney General, pursuant to the Answer of 8 May 2019 to Question 249931 on Prosecutions: West Midlands, what the average time was for the CPS to reach a decision in the West Midlands in each of the last five years.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4603", "label" : {"_value" : "Biography information for Preet Kaur Gill"} } , "tablingMemberConstituency" : {"_value" : "Birmingham, Edgbaston"} , "tablingMemberPrinted" : [{"_value" : "Preet Kaur Gill"} ], "uin" : "254257"} , {"_about" : "http://data.parliament.uk/resources/1126054", "AnsweringBody" : [{"_value" : "Attorney General"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1126054/answer", "answerText" : {"_value" : "

All complainants are entitled to protection from unnecessary and unjustified invasion of their private lives. Medical records and counselling notes will routinely engage an individual’s Article 8 ECHR right to privacy.

CPS guidance is clear that where it is a reasonable line of enquiry in the investigation, the police should obtain the complainant’s informed consent to gain access to these records and, in the limited circumstances where it is appropriate, to enable disclosure of material to the defence. Where records amount to unused material, prosecutors will robustly apply the relevant statutory provisions when deciding whether such material should be disclosed to the defence.

Income from the Victim Surcharge contributes to the Ministry of Justices’ Victim and Witness Budget (“the Budget”). This budget is used to fund Police and Crime Commissioners (PCCs) who commission local support services for victims, and nationally commissioned support services including the National Homicide Service, Rape Support Centres, and the Court Based Witness Service. Income from the Victim Surcharge is forecast into the Budget at the beginning of each financial year. However, actual income raised from the Surcharge will fluctuate each year (depending on the amount imposed and collection rates). Should revenue raised from the Surcharge go above the forecast amount, the excess is put towards compensating victims through the Criminal Injuries Compensation Scheme.

It is for the independent Parole Board to review the detention of those prisoners serving an IPP sentence who have completed their tariff period. The Board will direct the release of these prisoners only if it is satisfied that the levels of risk posed to the general public are reduced enough that the National Probation Service and its partner agencies can safely manage them in the community under supervision.
