Prison and Young Offender Institution (YOI) Rule 49 (Removal From Association - RFA) permits a Governor to segregate a young person from others (either generally or for particular purposes). Segregation under this rule must be desirable either for the maintenance of good order or discipline, or for the young person\u2019s own interests.<\/p>

<\/p>

Although Rule 49 (2b) provides that the governor must obtain leave from the Secretary of State in writing to authorise continuing segregation beyond 42 days, Her Majesty\u2019s Prison and Probation Service\u2019s policy on segregation mandates that young people cannot be segregated beyond 21 days without this leave being obtained.<\/p>

The safety and welfare of all young people held in custody is one of our highest priorities. When young people in custody are putting themselves or others at risk, segregation can be used as a last resort for limited periods of time when no other form of intervention is suitable. This is closely monitored by specialist staff and accompanied by a strategy of intervention.<\/p>

            The Independent Inquiry into Child Sexual Abuse published its Interim Report on 25 April. The Report contains a series of recommendations for specific changes, several of which are directed at Government. This includes recommendation that:<\/p>

            <\/p>

            • victims are supported in bringing their civil claims by the Association of British Insurers publishing a list of public liability insurers upon whom claims may be served; the law is changed so that victims are afforded the same protections as in criminal cases when they are claiming compensation<\/li><\/ul>

              <\/p>

              • the Departments of Health and Social Care, Education, the Ministry of Justice and the Home Office work together to establish current levels of expenditure and the effectiveness of that expenditure.<\/li><\/ul>

                The Government welcomes the Report and is now considering the Inquiry\u2019s recommendations very carefully.
