Employers have had a duty to prevent illegal working since 1997 by carrying out specified document checks on people before they employ them. Since 2008, this duty has been underpinned by a civil penalty scheme. In May 2014, this Government introduced measures making it simpler to check the immigration status of potential employees and at the same time doubled the maximum civil penalty to £20,000 for the employment of an illegal worker. The increased maximum civil penalty better reflects the harm caused by employing illegal workers, the costs to wider society and the unfair economic advantage derived from the activity.<\/p>

<\/p>

Where an employer knowingly employs an illegal worker the maximum penalty is two years\u2019 imprisonment and/or an unlimited fine.<\/p>

The sending of abusive messages or material online can cause misery for victims and is an issue the Government takes extremely seriously.<\/p>

<\/p>

That is why we are changing the law through the Criminal Justice and Courts Act to increase the maximum sentence to two years in prison for the offence of sending abusive or offensive material online with intent to cause distress or anxiety.<\/p>

<\/p>

We are also changing the law to enable prosecutions to take place three years after the alleged offence, rather than six months.<\/p>

<\/p>

There are a number of other serious penalties available in cases of cyber bullying of students.<\/p>

<\/p>

Under the Protection from Harassment Act 1997, the offences of harassment causing alarm or distress or putting people in fear of violence carry a maximum of six months and five years imprisonment respectively.<\/p>

<\/p>

There is also an offence under the Malicious Communications Act 1988 of sending material which is indecent, grossly offensive, obscene or menacing. It carries a maximum penalty of two years imprisonment.<\/p>

<\/p>

In addition, guidelines issued by the independent Sentencing Council stipulate that it is an aggravating factor if an offence is committed against a vulnerable victim or involves abuse of a position of power. Her Majesty\u2019s Courts & Tribunals Service (HMCTS) records the date of offence and date of trial in magistrates\u2019 courts and the Crown Court. However, a number of cases do not go to trial, either because the defendant pleads guilty or the prosecution drop the case. A number of offences committed during 2014 will not yet have reached six or twelve months since receipt by HMCTS. To answer this question would require the creation of complex reports to combine the variables within the question, which would then need to be tested, this would incur disproportionate costs.<\/p>

Also, offences committed in 2014 would be incomplete as many will not yet have reached six or 12 months since they were received by HMCTS.<\/p>
