The announcement of the \u2018Living With Covid\u2019 strategy means all Covid-related restrictions across the courts in England and Wales have been reviewed, and will be removed as quickly as possible. There is no longer a requirement to wear a face covering in our buildings in England and Wales. This applies both to staff offices, and to the public parts of our courts and tribunals. While the requirement has now been removed, government guidance still recommends wearing a face covering in crowded and enclosed spaces, especially where you are likely to come into contact with people you don\u2019t normally meet.<\/p>

We expect to be able to confirm what (if any) other measures will remain beyond April, which is when existing Government guidance on workplace/venue safety will be replaced. For the interim period, however, jurors who are using certain deliberation rooms assessed as too small to use without protection of fluid resistant face masks will continue to be asked to wear those masks in those areas of our buildings. Divorce and dissolution are a fundamental change of legal status that may have implications for people\u2019s rights and responsibilities, for matters such as property and inheritance, and for the families involved. Since the Matrimonial Causes Act 1857, divorce has always been a court process and only the court can legally end a marriage.<\/p>

<\/p>

However, divorcing couples can use family mediation to reach agreement about the arrangements for any children and for dividing their financial assets, rather than asking the court to decide these matters.<\/p>

<\/p>

This government is committed to supporting more families to resolve issues such as these through mediation, where appropriate. On 26 March 2021, a £1m Family Mediation Voucher Scheme was launched by the MoJ, to encourage and better support families to use mediation and resolve disputes outside of court.<\/p>

<\/p>

The Family Mediation Voucher Scheme is currently available in private law children cases where there are no safeguarding concerns and the case is deemed suitable for mediation. The scheme will offer over 2,000 families a financial contribution of up to £500 towards their mediation costs, giving these families the opportunity to resolve their disputes with the assistance of a trained mediator. Mediation Vouchers are offered, at the Mediation Information Assessment Meeting (MIAM) to ensure families are provided with information regarding the support they can get, before they decide to pursue their matters in the family court.<\/p>

<\/p>

We are closely monitoring the uptake and impact of the scheme and are actively considering what more could be done to encourage parties to consider mediation as an alternative to court, including better signposting of mediation as part of the implementation of the Divorce, Dissolution and Separation Act 2020.<\/p>

<\/p>

In order to promote the use of mediation as a first step towards dispute resolution for separating families, as of 22 April 2014 it is now a legislative requirement that anyone considering applying to court for an order about their children or finances is legally obliged to attend a Mediation Information and Assessment Meeting (MIAM) first, unless specific exemptions apply (for example domestic violence).<\/p>

<\/p>

Following this legislative change, attendance at MIAMs increased in consecutive quarters, with 4,023 couples attending a MIAM between Jul-Sept 2014, which is a rise of 11% from the previous quarter and 20% from Jul-Sept 2013. Mediation starts are also rising, with an increase from 1783 in the period Apr-Jun 2014 to 1896 in the period Jul-Sep 2014.<\/p>

<\/p>

We know that there is a perception by some people that legal aid no longer covers mediation or legal help for mediation. This is not the case, and it is vital that this message is communicated as effectively as possible. Legal aid remains available for family mediation and for legal advice to support family mediation. In addition, as of 3 November 2014, the first single session of mediation is publicly funded in all cases provided one of the people involved is already legally aided. In these cases, both participants will be funded for the MIAM and for the first session of mediation. The combination of the compulsory MIAM and free first mediation session will help to introduce more people to the benefits of mediation, and away from the courts.<\/p>

<\/p>

A communications campaign - \u2018First Stop: Family Mediation\u2019 - has been launched to promote family mediation, and how to access it, and publicising the availability of legal aid for those who are eligible. The campaign went live on 2 January 2015 and includes online advertising, Google key word searches and Google Display adverts that direct people to the Family Mediation Council website and in particular, the find your local mediator tool. Other initiatives included a sponsored Q&A discussion on Mumsnet as well as a social media campaign and media relations in the consumer media. This has resulted in a 320% increase in visitors to the FMC website in the first two months of the year as of 28 February this year compared to the last six months of 2014. The campaign runs until 20 March.<\/p>

<\/p>

To support the mediation profession, with MoJ assistance and guidance, the Family Mediation Council introduced a new Professional Standards Framework from 1 January 2015. This will provide the basis for a much needed consistent approach in how mediators should operate. It will allow the general public - the clients of mediation \u2013 to be confident in the service that is being provided; they will know what it means to go to mediation; they will understand that mediators are to be trusted as properly trained and accredited practitioners; and most importantly, they will know they are protected by a properly regulated profession.<\/p>

More widely, the Government actively encourages mediation in civil litigation cases through its support of the small-claims mediation service, and the mediation referral website. Signposting literature in the Courts, various provisions in the Civil Procedure Rules and the numerous pre-action protocols promote this. The Review Working Group is made up of professionals with expertise on mental capacity from across Government, the health, social care, legal and charity sectors. While there is no specialist expertise on speech and language therapy within the group, the Review has received responses from the profession as part of a Call for Evidence. The Ministry of Justice responded to the Victims\u2019 Commissioner\u2019s comprehensive review of the provision of Registered Intermediaries, making these commitments: to review governance of the Witness Intermediary Scheme; to consider whether to appoint a National Lead Registered Intermediary; to publish an annual report; and to promote the role of Registered Intermediaries.<\/p>

The department have delivered on these commitments and introduced improvements to governance, including the introduction of Regional Coordinator roles for exceptional Registered Intermediaries \u2013 which are more appropriate for the scheme than a National Lead.
